DBE CONTRACT GOALS. A. KDOT strongly encourages all contractors to utilize DBE firms as subcontractors, suppliers, manufacturers, truckers, and brokers whenever possible and feasible. Greater voluntary participation will result in lower and fewer DBE contract goals. KDOT will set DBE contract goals only to meet the portion of its annual goal that is not met by race and gender neutral means and voluntary participation.
DBE CONTRACT GOALS. It is the policy of the City of Rapid City that equal opportunity to participate in its procedures will be provided to DBE's. To accomplish this objective, the City of Rapid City requires the contractor to assert a good-faith effort to attain the specified goals for DBE participation. The amount of DBE participation will be determined by the dollar value of the work subcontracted to DBE's (as compared to the total value of all work performed under this contract) and/or by the percentage of the net profit which the parties agree will be shared by DBE's where a joint venture is entered into for the completion of the project. A contractor may satisfy the requirements by having DBE status, by subcontracting portions of the work to DBE's, and/or by entering into a joint venture with DBE's. The City of Rapid City has specified a DBE goal of 0 percent for the work to be performed under this contract. The City of Rapid City, in accordance with Title VI of the Civil Rights Act of 1964, 00 Xxxx. 000, 00 X.X.X. 0000x to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally Assisted Programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. APPENDIX A TO TITLE VI ASSURANCE During the performance of this contract, the contractor, for itself, its assignees and successors in interest (hereinafter referred to as the "contractor") agrees as follows:

DBE CONTRACT GOALS. Each scope of work prepared to procure consultant services or construction of the Work shall be evaluated by the CDOT Regional Civil Rights Office to determine a contract goal. The Local Agency shall be responsible for ensuring that the contract goal is incorporated into the procurement advertisement and accompanied by either:
DBE CONTRACT GOALS. If the project governed by the Agreement includes a DBE contract goal, SUB-RECIPIENT understands and agrees that it is required to strictly adhere to the requirements of 49 CFR Part 26 in its efforts to achieve the DBE contract goal.

The Trust and State Street have developed mutually acceptable performance goals dated March 1, 2011 , and as may be amended from time to time, regarding the manner in which they expect to deliver and receive the services under this Agreement (hereinafter referred to as “Service Level Agreement”). The parties agree that such Service Level Agreement reflects performance goals and any failure to perform in accordance with the provisions thereof shall not be considered a breach of contract that gives rise to contractual or other remedies.
