Day Shift Incentive Pay. Employees promoted (to Assistant Fire Marshal, Fire Marshal, or Medical Services Administrator) or assigned as set forth in Article 12, that are covered by this CBA working day shift (i.e., a 40 hour workweek), will receive Day Shift Incentive pay of eight percent (8%) of the base rate of pay. This incentive pay shall not apply in the case of (a) transfers of three (3) weeks or less, (b) assignment to the Deputy Fire Marshal positions or other positions where the incentive pay is included in the applicable rate of pay, or (c) as otherwise mutually agreed between the Employer and the Union)1, incentive pay shall apply for the entire period the employee is working in that position and on day shift. Captains or Battalion Chiefs acting in the classification of Deputy Chief shall receive day shift incentive pay.

Day Shift Incentive Pay. Employees regularly assigned by the Fire Chief to the Day Shift, excluding Fire Prevention, as identified in Article VIII, Section 2, will receive additional compensation of 6% added to their base wage, as identified in Appendix B. Employees regularly assigned to Fire Prevention will be classified and paid as listed in Appendix B. Employees in Fire Prevention positions shall be required to meet advancement requirements as outlined in Appendix A. Fire prevention positions will be filled after a civil service process and exam has occurred as required by the Fire Chief. An employee leaving a Day Shift assignment, shall have their pay “frozen” until it catches up to Appendix B at their regular hourly rate plus day shift premium, if they worked in the position for a minimum of thirty-six (36) consecutive months. If the Department reassigns the employee prior to thirty-six (36) months, not at the employee’s request, the wage shall be frozen until it catches up to Appendix B. corresponding to the length of time served on days. For example, an employee who worked for twelve (12) months on days and was moved back to a 24-hour shift, would have their pay frozen for an equivalent twelve (12) months. The employee shall not receive any wage or cost of living increases until their wage for the reassigned position catches up.

Upon verification and approval by the Department, within thirty (30) days of submission, the employee’s pay will be adjusted effective on the first day of the pay period following the date of submission by the employee. Any current employee with an EID classification will be adjusted to the non-EID rate, but will receive the annual incentive allowance as part of their hourly rate, spread over twenty-six (26) pay periods. The hourly rate will be calculated by dividing the annual educational incentive by 2,074 hours. Educational incentive pay will be included in the regular rate for overtime purposes. In addition, it will be counted as part of the employee’s annual salary for pension purposes, consistent with the prevailing Fire & Police Employees Retirement System regulations, and reflected on the salary schedules.
