Data shared with Subcontractors. If DSHS Data provided under this Contract is to be shared with a subcontractor, the Contract with the subcontractor must include all of the data security provisions within this Contract and within any amendments, attachments, or exhibits within this Contract. If the Contractor cannot protect the Data as articulated within this Contract, then the contract with the sub- Contractor must be submitted to the DSHS Contact specified for this contract for review and approval.

Data shared with Subcontractors. The Receiving Party will not enter into any Subcontract without the express, written permission of HCA, which will approve or deny the proposed subcontract in its sole discretion. If Data access is to be provided to a Subcontractor under this DSA it will only be for the Permissible Use authorized by HCA and the Receiving Party must include all of the Data security terms, conditions and requirements set forth in this DSA in any such Subcontract. In no event will the existence of the Subcontract operate to release or reduce the liability of the Receiving Party to HCA for any breach in the performance of the Receiving Party’s responsibilities.
