DATA PROTECTION ROLES. The parties hereby acknowledge and agree that Company is the Controller or Business, and Seagate is acting on behalf of the Company as the Processor or Service Provider with respect to the Company Personal Information, except where Company acts as Processor of Company Personal Information, in which case Seagate is a Sub-processor.
DATA PROTECTION ROLES. When processing personal data under the XXXX, Xxx0X will either act as Your processor or Your controller. Specifically, Pix4D will act as Your processor (i) in relation to any personal data about third parties appearing on the Content disclosed or otherwise made available to Pix4D via the Licensed Offerings and (ii) insofar as You license the Licensed Offerings for Use by the Authorized Users (including Your employees and other persons acting on Your behalf and in accordance with Your instructions) for which You act as the controller. In such cases, the processing of personal data by Pix4D on Your behalf will be governed by Pix4D's data processing agreement, available at xxxx://xxx0x.xxx/privacy, and to be executed between You and Pix4D (the "DPA"). Insofar You act as the controller of personal data, You shall ensure that the transfers of personal data from Pix4D (back) to You (processor to controller transfers) are permitted under applicable law and, where applicable, in accordance with the European standard contractual clauses incorporated in the relevant DPA.

Specifically, VOTIX will act as Your processor (i) in relation to any personal data about third parties appearing on the Content disclosed or otherwise made available to VOTIX via the Licensed Offerings and (ii) insofar as You license the Licensed Offerings for Use by the Authorized Users (including Your employees and other persons acting on Your behalf and in accordance with Your instructions) for which You act as the controller. In such cases, the processing of personal data by VOTIX on Your behalf will be governed by VOTIX's data processing agreement, available at xxxxx://xxxxx.xxx/privacy, and to be executed between You and VOTIX (the "DPA"). Insofar You act as the controller of personal data, You shall ensure that the transfers of personal data from VOTIX (back) to You (processor to controller transfers) are permitted under applicable law and, where applicable, in accordance with the United States of America standard contractual clauses incorporated in the relevant DPA.
DATA PROTECTION ROLES. The Parties agree in compliance with the definitions of the GDPR that the contracting party which, alone or jointly with others, determines the purposes and means of the processing of personal data shall be considered as the Controller. The Processor shall be the contracting party which processes personal data on behalf of the Controller. The decision as to which party acts as the Controller and which acts as the Processor shall be made according to objective criteria based on the Main Agreement.

  • Data Protection All personal data contained in the agreement shall be processed in accordance with Regulation (EC) No 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the EU institutions and bodies and on the free movement of such data.
