DAMAGE TO OTHER WORK. In carrying out his work, the Subcontractor shall take necessary precautions to protect the finished work of other trades from damage caused by his operations and Subcontractor shall repair and/or replace to the Company’s satisfaction and on the Company’s demand all damage caused by his operation at no expense to the Company. CLEAN UP: Subcontractor shall at all times keep the premises free from accumulations of waste material, lunch trash, debris or rubbish caused by his employees or work. At the completion of each work day he shall place all waste material, debris and rubbish from and about the project to the appropriate company supplied dumpster or trash receptacle, At the completion of each work week he shall remove or store in an approved area all his tools, equipment, waste and surplus materials and shall leave his work areabroom clean” or its equivalent. If work is conducted in an owner occupied space, then the work area shall be returned to the same condition or better than the original condition encountered upon completion of the work each day. If the subcontractor fails to comply with the housekeeping safety protocols or commence clean up duties within 24 hours after receipt from the Contractor of written notice of noncompliance, the contractor may implement such safety and cleaning measures without further notice and deduct the cost thereof from any amounts due or to become due to the subcontractor. SAFETY: The Subcontractor shall be responsible for initiating, maintaining and supervision all safety precautions and programs in connection with the performance of the Contract and shall conform to all provisions of the “Manual of Accident Prevention in Construction”, published by the Associated General Contractors of America, Inc. latest edition and the Subcontractor further agrees to fully comply with all safety standards required by the Occupational Safety and Health Administration (“OSHA”) 29 USC Section 651 et seq., and all amendments thereto. However, the Subcontractor’s duties herein shall not relieve any Sub-subcontractor and any other person or entity, including any person or entity required to comply with all applicable federal, state and local laws, rules, regulations and ordinances, from the obligation to provide for the safety of their employees, persons and property and their requirements to maintain a work environment free of recognized hazards. CLEAN UP: Subcontractor shall at all times keep the premises free from accumulations of waste material, debris or rubbish caused by his employees or work, and at the completion of each work week, he shall remove all the waste material, debris and rubbish from and about the project and all his tools, equipment, waste and surplus materials and shall leave his work “broom clean” or its equivalent. In case of dispute, the Company may remove the rubbish and charge the cost to the Subcontractor. Subcontractor will be charged on a pro-rata basis if he uses trash dumpster provided by the Company.
DAMAGE TO OTHER WORK. The Contractor will be held responsible for all damage to the premises, buildings, etc., that is caused by his work or anyone employed by him.

  • OTHER WORK 14.1 Owner may perform other work related to the Project at the site by Owner’s own forces, have other work performed by utility owners or let other direct contracts. If the fact that such other work is to be performed is not noted in the Contract Documents, written notice thereof will be given to Construction Contractor prior to starting any such other work. If Construction Contractor believes that such performance will involve additional expense to Construction Contractor or require additional time, Construction Contractor shall send written notice of that fact to Owner and Design Professional within seven (7) calendar days of being notified of the other work. If Construction Contractor fails to send the above required seven (7) calendar days’ notice, Construction Contractor will be deemed to have waived any rights it otherwise may have had to seek an extension to the Contract Time or adjustment to the Contract Amount.

  • DAMAGE TO PREMISES In the event the Premises are destroyed or rendered wholly uninhabitable by fire, storm, earthquake, or other casualty not caused by the negligence of Tenant, this Agreement shall terminate from such time except for the purpose of enforcing rights that may have then accrued hereunder. The rental provided for herein shall then be accounted for by and between Landlord and Tenant up to the time of such injury or destruction of the Premises, Tenant paying rentals up to such date and Landlord refunding rentals collected beyond such date. Should a portion of the Premises thereby be rendered uninhabitable, the Landlord shall have the option of either repairing such injured or damaged portion or terminating this Lease. In the event that Landlord exercises its right to repair such uninhabitable portion, the rental shall xxxxx in the proportion that the injured parts bears to the whole Premises, and such part so injured shall be restored by Landlord as speedily as practicable, after which the full rent shall recommence and the Agreement continue according to its terms.

  • Damage to Equipment The Parties shall exercise all necessary precautions to avoid causing damage to the other Party’s poles and Equipment and other pole attachers’ Equipment and shall assume responsibility to each other for any and all loss from any damage to the other Party’s poles or Equipment and reimburse the other Party for the entire expense incurred in making such repairs. Each Party shall assume responsibility to third parties for any and all loss from any damage caused to third party’s Equipment by such Party and shall reimburse such third party for the entire expense incurred in making repairs.

  • DAMAGE TO FACILITIES The Student will promptly report damages and request necessary repairs, in accordance with established and published procedures. The Student is responsible for damages caused by the Student. Damages to shared or common areas not attributable to a responsible person are the joint responsibility of all persons sharing the space or area. UCF DHRL reserves the right to charge the Student for damages caused by the Student. Charges may include, but are not limited to, extraordinary pest control charges, repair of walls, furniture or fixtures, and damages to common areas. The employee will present her or his receipt to the Employer within seven (7) days after the event, unless it was impossible for her or him to do so during this period. The Employer will reimburse up to a maximum of one hundred dollars ($100) per incident except for eyeglasses, which shall have a maximum reimbursement of three hundred dollars ($300).
