CUTTING AND PATCHING OF WORK. 3.19.1 The Construction Manager shall be responsible for all cutting, fitting, or patching that may be required to complete the Work or to make its several parts fit together properly.
CUTTING AND PATCHING OF WORK. Contractor shall be responsible for all cutting, fitting or patching of the Work that may be required to properly complete the Work or make its parts fit together properly. Any costs resulting from improper cutting, fitting and patching to any work performed by Owner or Owner’s Consultants shall be Contractor’s responsibility as a Cost of the Work. Contractor shall not damage or endanger a portion of the Work or fully or partially completed construction of Owner or separate contractors by cutting, patching or otherwise altering such construction, or by excavation. Contractor shall not cut or otherwise alter such construction by Owner or a separate contractor except with consent of Owner, which shall not be unreasonably withheld or delayed. Contractor, if required by Specifications and Drawings, shall make connections to materials or equipment furnished, set, and/or installed by other contractors. No Work connecting to such materials or equipment provided by other contractors shall be done without giving such contractors a reasonable length of time to complete their work or until permission to proceed has been obtained from Owner. Owner shall secure and provide to Contractor the Shop Drawings from Owner’s Contractors for such of their work as is to be built into Contractor’s Work, or to which Contractor must make connection, and Contractor shall review and advise Owner of any discrepancy or unsuitability relative to its own Work. Each party shall cause its contractors to provide all openings and chases in its own work necessary for the installation of process equipment, and shall fill in around the same afterwards, if required.

Contractor shall not unreasonably withhold from MSG or any Separate Contractor consent to cutting or otherwise altering the Work. MSG and Separate Contractors shall have reciprocal obligations as contained in this Section 3.19.1 to Contractor.

Should cutting, fitting or patching become necessary, it shall be performed to the minimum requirements as hereinafter stated and as stipulated elsewhere in the Contract Documents. Structural elements shall not be cut without the written consent of the DP. In all cases, the Contractor shall exercise extreme care in cutting operations and perform such operations under adequate supervision by competent mechanics skilled in the applicable trade. Openings shall be neatly cut and shall be kept as small as possible to avoid unnecessary damage. Careless and/or avoidable cutting, damage, etc., will not be tolerated, and the Contractor will be held responsible for such avoidable or willful damage. All replacing, patching and repairing of all materials and surfaces cut or damaged in the execution of the Work shall be performed by experienced mechanics of the several trades involved. Such replacing, repairing and/or patching shall be done with the applicable materials, in such a manner that all surfaces so replaced, etc., will, upon completion of the Work, match the surrounding similar surfaces. Landlord shall not damage or endanger any portion of the Base Building Work or the Tenant Work or any separate contractors by excavation or by cutting, patching or otherwise altering any work. Landlord shall not cut or otherwise alter the Tenant Work except with the written consent of Tenant. Cutting shall be accurately located and neatly done. Unnecessary cutting shall be avoided. Patching shall be done by skilled mechanics experienced in the particular type of work involved. Patching work shall conform to the standards of the specifications where applicable, and where not specified, such work shall conform to the highest standards of the trade. Finished patching work shall be acceptable to the contractor whose work has been patched. Landlord shall leave all open and uncovered holes, chases and other openings in its construction as required by Tenant for the installation of the Tenant Work, provided such openings are accurately located by the party requiring them before the execution of the construction. In no event shall a Delivery Date be deemed not to have occurred solely by reason of such holes, chases and other openings being left open and uncovered as so directed by Tenant. Without limitation to the generality of the foregoing, Landlord shall cause the ceiling and above-the-ceiling portions of the Base Building Work with respect to each Floor of the Premises to be left open and uncovered as reasonably directed by Tenant to the extent necessary to allow the timely and efficient performance of Tenant Work. Thereafter, Landlord shall cause such ceiling and above-the-ceiling work to be finally completed as and when reasonably directed by Tenant and in accordance with the Approved Base Building Plans and Specifications.
