Customer Facilities. 4.1 The Customer shall test Customer Facilities and ensure that they are complete, in good working order and ensure that all specifications are not less than the minimum determined by the Supplier.

(a) To the extent Provider is granted physical access to any Customer Facilities, Provider may access Customer Facilities solely (i) to provide the Services to Customer and for no other purpose and (ii) in strict accordance with any Customer Policies or other instructions issued by Customer.

Customer has sole responsibility for installation, testing and operation of the facilities, services and equipment (“Customer Facilities”) other than as specifically provided by Mosaic as part of the Services described in a Service Order. In no event will untimely installation or non-operation of Customer Facilities (e.g., local access, including cross connects, when Customer is responsible therefor) relieve Customer of its obligation to pay charges for the Services as of the Start of Service or upon cancellation / disconnection of Services.

Customer Facilities consist of water service pipelines, piping, meters, plumbing, and related appurtenances used to convey water from a Water Main to an individual Customer, including the physical connection of a service line to a Water Main. The dividing point between the Water Main and the Customer Facilities is the downstream end of the Corporation Stop. Customer Facilities shall be constructed in accordance with the requirements contained in the Rules and Regulations and with applicable building codes. (d)
Customer Facilities. On a quarterly basis, USFRS shall provide to EPA and MPCA the most current list of approved customers, identifying those newly added to the program, the customer’s process waste streams approved for participation in the USFRS XL Project, the unique identification number USFRS has assigned to the customer and its waste stream, the date of USFRS notice to EPA and MPCA and the date on which USFRS notified the customer that it is a USFRS XL Waste Approved Customer. The list shall also contain the date of any notice of termination, and if there is a termination, the date on which USFRS recovered all of its USFRS XL wastes from the customer and the date USFRS conducted its visual evaluation of the condition of the USFRS XL waste storage areas. USFRS shall collect and report to EPA and MPCA on a quarterly basis the following data for each customer facility participating in the XL project:

Upon a date to be notified by Telephone Europe, Telephone Europe may inspect Customer Facilities at the Customer’s premises in accordance with the terms of this Agreement.
Customer Facilities. If necessary for the engagement, Customer will permit CBTS access to Customer’s facilities and personnel, in accordance with Customer’s normal security procedures. Customer will communicate such procedures in writing to CBTS prior to beginning such work.
