Customer as Controller. Customer remains the sole Controller of the Customer Data pursuant to the applicable Data Protection legislation (meaning that Customer alone determines the purposes and means of processing the Customer Data), and shall be responsible for the lawful processing of the data as well as for preserving the rights of the data subjects. Where required, Customer shall inform the data subjects about the processing of their data, and/or obtain their consent. The Customer shall be responsible for obtaining the data subjects’ consent and demonstrating the lawful basis of processing where applicable. Where Customer Data must be corrected, deleted or blocked, Customer itself shall carry out these measures by using the corresponding functions of the provided software. Where this is not possible, QIVOS shall correct, delete or block such data according to the documented instructions provided by Customer at Customer’s risk and expense.
Customer as Controller. Customer agrees that XXXX and Google are processors, and Customer is the controller, of any personal data referenced in this Article.
Customer as Controller. 2.2.1. Customer is solely responsible for the accuracy of Customer Personal Data and the legality of the means by which Customer acquires Customer Personal Data.
Customer as Controller. Customer represents that it is the sole controller of the personal data for the purposes of the GDPR and applicable data protection laws and has all necessary rights, and has obtain all necessary consents to use the personal data with the Accellion Solution. Customer has the right to give instructions regarding the nature, scope and process of personal data pursuant to express terms in the GDPR. Accellion will comply and maintain records for all such instructions to the extent necessary for Accellion to: (i) comply with its processor obligations under the GDPR and applicable law; or (ii) assist Customer to comply with Customer’s obligations as a controller under the GDPR or applicable law relevant to Customer’s use of the Accellion Solution. Customer represents and warrants that is responsible for the lawfulness of the processing of the personal data using the Accellion Solution and Customer agrees that it will not use the Accellion Solution in conjunction with personal data to the extent that doing so would violate the GDPR or applicable data protection laws. Customer further represents and warrants that personal data used with the Accellion Solution will not subject Accellion to any obligations beyond those set forth in the Agreement, the DPA or any other written agreement between the parties.
Customer as Controller. To the extent Customer Data constitutes Personal Data, the Parties agree that Customer determines the purpose and means of processing such Personal Data, and Reveal processes such information on behalf of Customer. Therefore, the Customer must be considered as the controller and Reveal as a processor.

Customer as Controller. Customer is solely responsible for ensuring that (i) the Personal Data submitted to us for Processing is duly authorized, with all necessary notices, rights, permissions, and consents (to include effective opt-out options); (ii) your instructions to us comply with Data Protection Laws and are consistent with the Agreement; and (iii) no special categories of Personal Data (e.g., under GDPR Article 9) are submitted to us for Processing. For clarity, SMA Technologies does not – nor are we obligated to – assess the type or substance of Customer Content to identify whether it is Personal Data and/or subject to any specific legal requirements.
Customer as Controller. To the extent Service Data constitutes Personal Data, the Parties agree that Customer determines the purpose and means of processing such Personal Data, and RealCISO processes such information on behalf of Customer.
