Curtailment or Interruption of Service. The Transmission Provider reserves the right to curtail, in whole or in part, Non-Firm Point-to-Point Transmission Service provided under the provisions herein for reliability reasons when an emergency or other unforeseen condition threatens to impair or degrade the reliability of its Transmission System. The Transmission Provider reserves the right to interrupt, in whole or in part, Non-Firm Point-to-Point Transmission Service provided under the provisions herein for economic reasons in order to accommodate (1) a request for Firm Transmission Service, (2) a request for Non-Firm Point-to-Point Transmission Service of greater duration, (3) a request for Transmission Service for Network Customers from non-designated resources, or (4) transmission service for Firm Point-to-Point Transmission Service during conditional curtailment periods as described in Section 15.4. The Transmission Provider shall also interrupt or curtail service to the Transmission Customer to the extent that deliveries for transmission are interrupted or curtailed at the Point(s) of Receipt. Where required, Curtailments or Interruptions shall be made on a non-discriminatory basis to the transaction(s) that effectively relieve the constraint; however, Non-Firm Point-to-Point Transmission Service shall be subordinate to Firm Transmission Service. Should multiple transactions require Curtailment or Interruption, to the extent practicable and consistent with Good Utility Practice, Curtailments or Interruptions shall be made to transactions of the shortest term (e.g., hourly non-firm transactions shall be curtailed or interrupted before daily non-firm transactions, and daily non-firm transactions shall be curtailed or interrupted before weekly non-firm transactions). Transmission Service for Network Customers from resources other than designated resources shall have a higher priority than any Non-Firm Point-to-Point Transmission Service under the provisions herein. Non-Firm Point-to-Point Transmission Service over secondary Point(s) of Receipt and Delivery shall have lower priority than any Non-Firm Point-to-Point Transmission Service under the provisions herein. The Transmission Provider shall provide advance notice of Curtailment or Interruption where such notice can be provided consistent with Good Utility Practice.

Curtailment or Interruption of Service. Lessor reserves the right to interrupt, curtail, or suspend the provision of any utility service to which Lessee may be entitled when necessary by reason of accident or emergency or for repairs, alterations, or improvements that Lessor deems desirable or necessary, or due to difficulty in obtaining supplies or labor or for any other cause beyond the reasonable control of Lessor. The work of such repairs, alterations, or improvements shall be made with reasonable diligence. Lessor shall in no respect be liable for any failure of the utility companies or governmental authorities to supply utility services to Lessee or for any limitation of supply resulting from governmental order or directives. Lessee shall claim no diminution or abatement of rent, nor damages, by reason of such interruption, curtailment, or suspension, nor shall this Lease or any of Lessee's obligations by reduced or affected.

Landlord shall in no respect be liable for any failure of the utility companies or governmental authorities to supply utility services to Tenant or for any limitation of supply resulting from governmental orders or directives. Tenant shall claim no diminution or abatement of rent, nor damages, by reason of such interruption, curtailment, or suspension, nor shall this Lease or any of Tenant’s obligations be reduced or affected, provided the interruption, curtailment or suspension is for a reasonable period of time and Landlord proceeds with reasonable diligence in its repairs.

  • Interruption of Service If required by Good Utility Practice or Applicable Reliability Standards to do so, the NYISO or Connecting Transmission Owner may require Developer to interrupt or reduce production of electricity if such production of electricity could adversely affect the ability of NYISO and Connecting Transmission Owner to perform such activities as are necessary to safely and reliably operate and maintain the New York State Transmission System. The following provisions shall apply to any interruption or reduction permitted under this Article 9.6.2:

  • Interruption of Services Tenant agrees that Landlord shall not be liable in damages, by abatement of Rent or otherwise, for failure to furnish or delay in furnishing any service, or for any diminution in the quality or quantity thereof, when such failure or delay or diminution is occasioned, in whole or in part, by repairs, renewals, or improvements, by any strike, lockout or other labor trouble, by inability to secure electricity, gas, water, or other fuel at the Building after reasonable effort so to do, by any accident or casualty whatsoever, by act or default of Tenant or other parties, or by any other cause beyond Landlord’s reasonable control; and such failures or delays or diminution (any such event, a “Service Failure”) shall never be deemed to constitute an eviction or disturbance of Tenant’s use and possession of the Premises or relieve Tenant from paying Rent or performing any of its obligations under this Lease. Notwithstanding the foregoing, if the Premises, or a material portion of the Premises, is made untenantable (that is, Tenant cannot conduct its business in such portion) or inaccessible for a period in excess of five (5) consecutive business days as a result of the Service Failure that has been caused by Landlord’s act or omission with respect to matters within Landlord’s control (“Controlled Service Failure”), then Tenant, as its sole remedy, shall be entitled to receive an abatement of Rent payable hereunder during the period beginning on the sixth (61 ) consecutive business day of the Controlled Service Failure and ending on the day the service has been restored. If the entire Premises has not been rendered untenantable or inaccessible by such a Controlled Service Failure, the amount of abatement that Tenant is entitled to receive by reason of such a Controlled Service Failure shall be prorated based upon the percentage of the Premises rendered untenantable or inaccessible and not used by Tenant. Notwithstanding the foregoing, business days during which the Premises or a material portion thereof are untenantable or inaccessible, or during which all or nearly all the Premises are unusable, by reason of a Service Failure which arises from a fire or other casualty which is covered by the provisions of ARTICLE 13 shall in no event be considered in determining whether Tenant is entitled to an abatement of Rent under this Section 8.03 (in such event the provisions of Section 13.01 shall govern Tenant’s rights). In no event shall Landlord be liable to Tenant for any loss or damage, including the theft of Tenant’s property, arising out of or in connection with the failure of any security services, personnel or equipment.

  • Cessation of Service The option term specified in Paragraph 2 shall terminate (and this option shall cease to be outstanding) prior to the Expiration Date should any of the following provisions become applicable:

Furthermore, Landlord shall not be liable under any circumstances for a loss of, or injury to, property or for injury to, or interference with, Tenant's business, including, without limitation, loss of profits, however occurring, through or in connection with or incidental to a failure to furnish any of the services or utilities as set forth in this Article 6.

  • Termination of Services 6.2.   • Termination of Service Relationship If the Optionee’s Service Relationship with the Company or a Subsidiary (as defined in the Plan) is terminated, the period within which to exercise the Stock Option may be subject to earlier termination as set forth below.
