Cultural Resources Assessment. The project will occur on lands owned by Xxxxxxxxxx County, a subdivision of the State of Texas. Therefore, the project is subject to the Antiquities Code of Texas (ACT) and the accompanying Rules of Practice and Procedure, which protects archaeological sites and historic buildings on public land. This scope of work is designed to meet all requirements of the ACT and includes a cultural resources assessment and consultation with the Texas Historical Commission (THC), which also serves as the State Historic Preservation Office. The goal of this work will be to determine the level of effort required for further investigation and coordination with the THC.
Cultural Resources Assessment. The Consultant will perform a cultural resources assessment for the selected project site(s). Because the project would be funded by federal funds from HUD, the project is considered a Federal Undertaking and will need to comply with Section 106 of the National Historic Preservation Act of 1966 (NHPA). To comply with these regulations and inform the CEQA review of cultural resources, a cultural resources record search and field survey will be conducted on up to approximately 161 acres of land, and an archaeological inventory and evaluation report will be prepared for the Area of Potential Effect (APE). Field work will be carried out during spring/summer 2021, and a draft Cultural Resources Assessment report will be submitted for review and comment. A final report will be prepared that will address guidance provided by RCAC, HCD, SNC, and the CEQA lead agency. The project archeologist will also be available to support coordination with the State Historic Preservation Office (SHPO) regarding the findings of the assessments. The Consultant will conduct Native American outreach as needed to comply with Section 106 for all contracted work. A Sacred Lands File search will be requested from the Native American Heritage Commission. Natural Investigations will assist HCD and the CEQA lead agency staff with ongoing consultations with interested tribes in accordance with Section 106. If requested, Natural Investigations will also help the CEQA lead agency with responses to AB 52 consultation requests from geographically affiliated tribes regarding the potential of the project to adversely affect tribal cultural resources. Tribal outreach is assumed to be an ongoing process throughout the project.

Baseline Cultural Resources Inventory for CEQA Compliance The following tasks serve to provide an assessment of impacts to cultural resources in conformance with CEQA regulations and City guidelines and requirements. Xxxxx understands that the City is lead agency on this project for purposes of CEQA compliance and that no federal nexus has been identified that would require compliance with Section 106 of the National Historic Preservation Act. The specific tasks required to prepare the CEQA-compliant cultural resources assessment are identified below. Any changes to the scope or assumptions provided herein may result in the need for an additional separate scope and fee estimate. The proposed development is limited to the 61-acre Gateway Site and approximately 15-acre Xxxxxxx Open Space Trail extension, comprising approximately 76 acres (project site) as mapped in the Request for Proposals (RFP) exhibit for the proposed project. However, for the purposes of this scope, Xxxxx will incorporate a desktop cultural resource review of the approximately 126-acre Gateway development area that surrounds the 76-acre site as part of the baseline study for cultural resources to provide an understanding of the archaeological sensitivity within and surrounding the proposed project site. Survey of this expanded area is not included in the present scope of work.

The review would be performed to inform the selection of the preferred intersection designs and multimodal improvements. The review will include the following sub-tasks. • The background review will include cultural resource survey data and records on file with the Department of Archaeology and Historic Preservation, and documents in AINW’s library, including survey reports, historical maps (early USGS, regional, etc.) of the area, and General Land Office maps of the project area. The objective will be to identify recorded archaeological and historic resources and areas that have been previously surveyed for cultural resources. • AINW would conduct a reconnaissance by vehicle to assess the existing conditions for the alignment alternatives, and to determine if previously recorded resources may have been removed by developments over the past few years. • For areas that have not been surveyed for archaeological or historic resources, AINW would estimate the probability of encountering a significant resource on a scale of High, Moderate, or Low. The estimate will be based on LiDAR data, historical records, the reconnaissance review of current conditions, and the statewide archaeological probability model. • The results would be summarized in an email, and note the location of any ‘red flags’ that might be found.
