Common use of Criminal Liability Clause in Contracts

Criminal Liability. 52:01 If an employee is charged with a criminal offence arising out of an alleged action or omission while acting within the scope of their duties, provided such actions do not constitute gross negligence or disregard of duty, or do not constitute fraud or a malicious act or omission, then the Chief Operating Officer shall review such incident(s) on an individual basis to consider the appropriateness of assisting the employee based on the circumstances. The decision whether to provide assistance, and the manner of any such assistance shall be at the discretion of the Chief Operating Officer.
