CRIMINAL HISTORY BACKGROUND CHECK. Pursuant to Sections 22.0834, 22.0835 and 22.085 of the Texas Education Code, Provider hereby certifies that all employees, subcontractors and volunteers of the Provider who are hired by Provider on or after January 1, 2008, who have or will have continuing duties related to the contracted services, and have or will have direct contact with students, have passed a national criminal history background record information review as required by those sections. Provider must provide a list of the names and dates of birth of all employees who have passed the background check to District’s Office of Ethics & Compliance in person or via email at xxxxxx@xxxxxxxxxx.xxx. If Provider’s employees, subcontractors or volunteers have no contact with HISD students, Provider shall so certify on a prescribed form to the Office of Ethics & Compliance, and will be considered to be in compliance with the requirements of this contract. X Provider's Signature Provider shall send or ensure that the employee or applicant sends to the Texas Department of Public Safety (“DPS”) information that is required by the DPS for obtaining national criminal history record information, which may include fingerprints and photographs. DPS shall obtain the person’s national criminal history record information and report the results through the criminal history clearinghouse as provided by Section 411.0845, Government Code. Providers that have more than 4 employees must set up an account with the Texas Department of Public Safety (“DPS”) in order to obtain criminal histories on their covered employees. To set up an account with DPS, a Provider should contact the crime records service bureau at 000-000-0000. Providers with up to 4 employees must obtain a FAST PASS from the District in order to obtain their criminal history. Appointments must be made with IdentoGo, in accordance with the instructions included with the FAST Pass, who will then notify HISD electronically that the background checks have been done. Providers should contact the District’s Human Resources Department to obtain the FAST PASS and scheduling instructions at 000 000-0000. Providers must present a list of all employees who may have direct contact with students to HISD. Provider must also obtain certifications from all subcontractors that their employees to whom Section 22.0834 applies have also passed a national criminal history background record information review. CRIMINAL HISTORY BACKGROUND CHECK. Any Contractor, at his or her own expense, must obtain from the law enforcement clearing house as provided for in Section 411.0845, Government Code, any law enforcement or criminal justice agency or a private entity that is a consumer reporting agency governed by the Fair Credit Reporting Act (15 U.S.C. Section 1681 et seq.) all criminal history record information that relates to Contractor, an employee or agent of Contractor in accordance with Texas Education Code Section 22.0834 if: (1) the individual has continuing duties related to the contracted services; and (2) the individual has direct contact with students. The review must be completed before services are performed under this Contract. Additionally, Contractor must obtain certification form all subcontractors, if any that their employees to whom Section 22.0834 applies, have passed the required criminal history background review. Contractor shall certify to District that it has received all of the criminal history record information required by completing Exhibit A to this Contract. District reserves the right pursuant to TEC 22.0834 to obtain from any law enforcement or criminal justice agency all criminal history record information that relates to Contractor or its employees or agents. Amendment: This Contract may be amended or modified only by written agreement of all parties. No Waiver of Immunity: District does not waive or relinquish any immunity or defense on behalf of itself, its Trustees, officers, employees, and agents in conjunction with this. Jurisdiction and Venue: This Contract shall be construed in accordance with the laws of the State of Texas and the parties agree that venue shall be in Xxxxxxxxxx County, Texas. The notice must include a general description of the conduct resulting in the conviction of a felony. The district may terminate this contract if the district determines that the person or business entity failed to give notice as required by Section 44.034 (a) or misrepresented the conduct resulting in the conviction. Additionally, Contractor must obtain certification form all subcontractors, if any that their employees to whom Section 22.0834 applies, have passed the required criminal history background review. CRIMINAL HISTORY BACKGROUND CHECK. A background criminal history clearance is required every three years for all employees, subcontractors, and/or volunteers who may have unsupervised access to youth under this contract. The MTF will conduct criminal background checks on all health care workers involved in the delivery of healthcare to children, under the age of 18 on a frequent and regular basis, as stated in XXXX 1402.5, Enclosure 5. The Contractor is responsible for ensuring the completed Standard Form 86 (Questionnaire for National Security Positions) is contained in credentialing packages for privileged health care providers and submitted for non-privileged health care workers prior to providing services at the MTF. The Contractor shall ensure that the health care worker follows local MTF policy to provide fingerprints on a properly completed FD Form 258 (FBI US Department of Justice Fingerprint Card). The procedures for completing the required background check are outlined in the Department of Defense Instruction (XXXX) 1402.5.
CRIMINAL HISTORY BACKGROUND CHECK. The Contractor shall initiate a criminal history background check independently or through the Children’s Administration pursuant to RCW 43.43.832, 43.43.834, and 43.20A.710 or successor statutes for all current employees, volunteers, subcontractors, and other persons who may have unsupervised access to children, developmentally disabled persons, or vulnerable adults. Such persons shall not have unsupervised access to children, developmentally disabled persons, or vulnerable adults until a satisfactory background check is completed and documentation qualifying the individual for unsupervised access is returned to the Contractor.
