Credit Union’s Liability. If we do not complete a transfer to or from your Account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance:  If, through no fault of ours, you do not have enough money in your Account to make the transfer.  If the terminal or system where you are making the transfer does not have enough cash.  If the ATM or system was not working properly and you knew about the breakdown when you started the transfer.  If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.  If the funds in your Account are subject to an administrative hold, legal process, or other claim.  If the failure to properly complete the transaction is caused by erroneous information supplied by you or your agent.  If you have closed the Account from which you have preauthorized electronic fund transfers to occur.  There may be other exceptions stated in our agreements with you.

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance: • If, through no fault of ours, you do not have sufficient available funds in your account or back up accounts to make the transfer, if any funds in your accounts necessary to complete the transfer are held as uncollected funds or pursuant to our Funds Availability Policy, or if any funds in your accounts necessary to complete the transaction are held subject to legal process or other claim. • If you used your card or access code in an incorrect manner, or after your right to use your card or access code has been cancelled. • If the automated teller machine (ATM) where you are making the transfer does not have enough cash. • If the ATM or other terminal or system was not working properly, and you knew about the breakdown when you started the transfer. • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken • If funds in your account necessary to complete the transaction are pledged as collateral, are frozen, or offset because of a delinquent loan. • If the error was caused by a system of any participating ATM network. • If the transfer is not completed as a result of your negligent use of your card, access code, or any EFT facility for making such transfers. • If the telephone or computer equipment you use to conduct audio response or electronic/PC transactions is not working properly and you knew or should have known about the breakdown when you started the transaction. • If a law or regulation prevents us from completing the transaction. • If any other exception as established by us and communicated to you applies.

MEMBER’S LIABILITY Tell us AT ONCE if you believe your Visa® debit card and/or code has been lost or stolen, or if you believe that an electronic fund transfer has been made without your permission using information from your check or draft. Telephoning is the best way of minimizing losses. All the money in your account, plus your overdraft line of credit, could be withdrawn. If you tell us within 2 business days after you learn of the loss or theft of your card and/or PIN, you can lose no more than $50 if someone uses your card and/or PIN without your permission. If you do NOT tell us within 2 business days after you learn of the loss or theft of your card and/or PIN, and we can prove we could have stopped someone from using your card and/or PIN without your permission if you had told us, you could lose as much as $500. Also, if your statement shows transfers that you did not make, including those made by card , PIN or other means, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. Additional Limit on Liability for Visa® Debit Card. Unless you have been grossly negligent or have engaged in fraud, you will not be liable for any unauthorized transactions using your lost or stolen Visa® Debit Card. Credit Union’s Liability. The Credit Union is responsible for any damages you incur in connection with any Online Account if the damages were directly caused by the Credit Union's failure to complete any transfer or bill payment you have properly requested through COFCU’s digital banking services in accordance with this Agreement, the applicable Account Agreements, and applicable law. However, the Credit Union will not be liable under certain circumstances, including: • If, through no fault of the Credit Union, you do not have enough money in the Online Account to complete a transaction from that account; • If the amount of the transfer would exceed the amount of available credit under any overdraft protection line of credit for the related Online Account; • If you have not properly followed instructions provided in connection with your Internet Computer or Software, if your Internet Computer fails to meet the Technical Standards required to access and use COFCU’s digital banking services or if your Internet Computer or Software fails or malfunctions; • If you have not complied with the Credit Union's instructions in this Agreement (which includes the Online Terms) on how to make the transfer or bill payment; • If the Credit Union has not received complete, correct, and current instructions so that the Credit Union can make the requested transfer or bill payment; • If you do not authorize a transfer or bill payment soon enough for your payment to be received by the payee by the time it is due, or you schedule a payment to be made after its due date; • If withdrawals from the applicable Online Account have been prohibited by a court order such as a garnishment or other legal process; • If your Online Account is frozen because of dispute about ownership; • If your Internet Computer, your Software, or COFCU’s digital banking platform was not working properly and you knew about this problem when you attempted to authorize a transfer or bill payment; • If circumstances beyond the Credit Union's control prevent making a transfer or bill payment, despite reasonable precautions that the Credit Union has taken. Such circumstances include, without limitation, conflicts with federal or state law or regulation, acts of civil or military authority, national emergencies, insurrection, war, riots, labor difficulties, natural disasters, acts of God, weather conditions, flaws in your Software or Internet Computer, equipment failure or malfunction, material shortage, or failure or malfunction of pow...
