Common use of Covenant Breaches Clause in Contracts

Covenant Breaches. (i)The Borrower shall (A) fail to perform or observe any covenant contained in Section 5.01, 5.02, 5.05, 5.06, 5.07, 5.08, 5.09 or Article VI of this Agreement or (B) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Credit Document which is not covered by clause (i)(A) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days after the earlier of written notice of such default shall have been given to such Person by the Agent or any Bank or such Person's actual knowledge of such default or (ii) any Guarantor shall fail to perform or observe any covenant contained in its Guaranty;

(i)The Borrower shall (A) fail to perform or observe any covenant contained in Section 5.015.1, 5.025.2, 5.055.5, 5.065.6, 5.075.7, 5.08, 5.09 or 5.8 or Article VI of this Agreement or (B) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Credit Document which is not covered by clause (i)(A) above or any other provision of this Section 7.01 7.1 if such failure shall remain unremedied for 30 days after the earlier of written notice of such default shall have been given to such Person by the Agent or any Bank or such Person's actual knowledge of such default or (ii) any Guarantor shall fail to perform or observe any covenant contained in its Guaranty;

(i)The Borrower shall (A) fail to perform or observe any covenant contained in Section 5.015.2, 5.025.3, 5.055.5, 5.065.6 (except for clauses (i) and (j) thereof), 5.07, 5.08, 5.09 5.8 or 5.13 or Article VI of this Agreement or (B) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Credit Document which is not covered by clause (i)(A) above or any other provision of this Section 7.01 7.1 if such failure shall remain unremedied for 30 days after the earlier of written notice of such default shall have been given to such Person by the Agent or any Bank or such Person's ’s actual knowledge of such default or (ii) any Guarantor shall fail to perform or observe any covenant contained in its Guaranty;

(i)The i) The Borrower shall (A) fail to perform or observe any covenant contained in Section 5.01Sections 5.3, 5.025.4, 5.05or 5.6, 5.06, 5.07, 5.08, 5.09 or Article VI of this Agreement Agreement, or (Bii) the Borrower or any Guarantor shall fail to perform or observe any other term or covenant set forth in this Agreement or in any other Credit Document which is not covered by clause (i)(Ai) above or any other provision of this Section 7.01 7.1 if such failure shall remain unremedied for 30 days after the earlier of the date written notice of such default shall have been given to the Borrower or such Person Guarantor by the Administrative Agent or any Bank or such Person's the date a Responsible Officer of the Borrower or any Guarantor has actual knowledge of such default or (ii) any Guarantor shall fail to perform or observe any covenant contained in its Guarantydefault;
