Common use of Covenant Breaches Clause in Contracts

Covenant Breaches. Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower or Parent), 5.04(a), 5.06(a) and (b), 5.07(a), (e), and (g), 5.09(b) and 5.10 and Article VI of this Agreement or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days;

Covenant Breaches. Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower or Parent), 5.04(a), 5.06(a) and (b)5.01, 5.07(a), (e5.07(e), and (g)5.09, 5.09(b) and 5.10 5.11, 5.12, 5.14 and Article VI of this Agreement or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days;

Covenant Breaches. Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower or Parent), 5.04(a), 5.06(a) and (b)Section 5.01, 5.07(a), (e)5.09, and (g)5.11, 5.09(b) and 5.10 and 5.12, 5.17, or Article VI of this Agreement VI, or (ii) fail to perform or observe any covenant contained in Section 5.06(e), 5.06(k), 5.06(l), or 5.16 if such failure shall remain unremedied for five Business Days, or (iii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) or clause (ii) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days;

Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower or Parent), 5.04(a), 5.06(a) and (b)5.01, 5.07(a), (e)5.09, and (g)5.11, 5.09(b) and 5.10 5.12, 5.14, and Article VI of this Agreement or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days;

Covenant Breaches. Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower or Parent), 5.04(a), 5.06(a) and (b)5.01, 5.07(a), (e)5.09, 5.11, and (g), 5.09(b) and 5.10 5.12 and Article VI of this Agreement (provided that, with respect to Section 6.23 only, such failure shall remain unremedied for 15 days) or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days;

Covenant Breaches. Any Loan Party or any Restricted Subsidiary thereof shall fail to (i) fail to perform or observe any covenant contained in Sections 5.01 Section 5.02(a), Section 5.03 (with respect to either Holdings’ or the existence of the Borrower or ParentBorrower’s existence), 5.04(aSection 5.06(i), 5.06(a) and (b)Section 5.09, 5.07(a), (e), and (g), 5.09(b) and 5.10 and or Article VI of this Agreement or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 daysdays after the occurrence of such breach or failure;
