COURT TIME PAY. A. Court time occurs when an employee not on duty is required to testify concerning the official performance of duty in municipal, magistrate, district, federal court, or state administrative hearings.

COURT TIME PAY. An officer required to appear in court in the performance of his official duties, outside his normal duty schedule shall, be compensated in accordance with Sections 7.4 and 7.5B. If the meeting or court appearance exceeds two (2) hours, the officer shall receive overtime compensation (time and one half) for the actual time spent by the officer in excess of that two hour minimum.
COURT TIME PAY. With the exclusion of any employee(s) separated or retired from City employment prior to the date of final ratification of this Agreement, court appearances and other court duties performed by Criminalists or Officers, including appearances and duties involving civil cases, required by the City occurring on other than an employee's assigned shift, will be compensated at time and one-half, irrespective of any other provisions for overtime pay based upon their then current work period or other shift assigned as determined by the City. Except as outlined herein; court pay shall not be paid to employees whose court appearance, hearing, deposition or Pre-filing interview (PFI) falls within one and one half (1.5) hours prior to the start of their assigned work hours or within one and one half (1.5) hours after their assigned work hours. Employees assigned to court appearance(s) within one and one half (1.5) hours pre-shift or post-shift, shall be deemed to be in an on duty status instead of court time status. Employees shall receive a minimum of two (2) hours pay at time and one-half for each such off-duty court-related appearance, irrespective of the number of cases involved in each appearance, except as outlined herein. Such court time, however, shall not be counted as "time worked" for overtime purposes except as outlined herein. Employee has the option to request court time compensation at time and one-half or request equivalent compensatory time, provided the employee meets the criteria outlined herein, and provided that the employee's accumulated compensatory time and court time, shall not exceed 480 hours. The City, in its sole discretion, may either pay said employees as provided in this Section, or grant equivalent compensatory time off.
COURT TIME PAY. The City agrees that a Police Unit employee subpoenaed to court to testify in an official capacity, when not regularly scheduled to be on duty, and who makes a reasonable effort to coordinate with the appropriate representative of the subpoenaing agency to ascertain the time of testimony, shall be paid at the overtime rate for a minimum of 2.5 hours when the court is in Simi Valley, and a minimum of 4.5 hours when the court is outside of Simi Valley. If court appearances take longer than these minimums, the employee will be paid for actual time involved. If a court appearance outside Simi Valley is called off, prior to the employee's departure from Simi Valley, the minimum for a Simi Valley court appearance will be paid. The City does not pay for travel time to or from an employee's residence, in connection with court proceedings. Court time shall start at the Police Station or court, at the employee's selection, unless otherwise directed by the department. If court appearances start while on-duty, but due to circumstances beyond the employee's control, extend beyond regular work hours, only the time beyond normal work hours shall be paid. No minimums shall be applicable. If an employee is subpoenaed for anything other than traffic court, the court time minimum shall stay in effect until the employee is released for the day, provided that if the employee actually works more time than the court time minimum, he/she shall be compensated for the actual time worked. If an employee is subpoenaed for traffic court, up to two court time minimums can apply if an employee is subpoenaed for a both a morning and an afternoon time slot and those two start times are at least 2.5 hours apart. Timesheets shall reflect the actual time of arrival in court and departure from court, even in instances involving minimum allowance for court as specified. Timesheets shall reflect the actual time of leaving the Police Station, arrival at court, leaving court, and return arrival at the Police Station. Court Time Pay will be provided regardless of whether the duty hours overlap with minimum court time.
COURT TIME PAY. 9.01 Members attending court on off hours will receive a minimum credit of three (3) hours at time and one-half (1½). Should a court sitting extend beyond three (3) hours the additional hour(s) or part thereof shall be payable at time and one-half (l½). The hourly rate will be calculated on the Member's basic annual salary for fifty-two (52) weeks of forty (40) hours. Morning and afternoon attendance shall be recorded as separate appearances. Morning court shall be deemed to be any sitting which commences at or after nine a.m. and ends at or before one-thirty p.m. If morning court extends beyond one-thirty p.m., it shall be deemed to be an afternoon appearance. Afternoon court shall be deemed to be any sitting which commences at or after one-thirty p.m.
COURT TIME PAY. An officer who is required to attend any Court or hearing for official business related to their duties as an Augusta Police Officer or on other Police related matters recognized by the City as being within the officer's official duties while off-duty will be paid at the rate of one and a half (1 1/2%) times their regular hourly rate for four (4) hours time or for the actual hours spent in excess of four hours attending Court or hearing while off duty. Payment shall be made within a reasonable length of time after submittal of the Court remuneration. If the Court appearance is not deemed to be covered by the above, the employee shall be paid by the Court, the Attorney requesting the appearance, other Departments, Agency, Entity or Individual ordering such appearance.
COURT TIME PAY. Section 19.01 Any employee covered by this Agreement who is required by the City to attend Court outside of his/her regular work shift shall receive a minimum of four (4) hours pay at his/her applicable hourly rate for such attendance. No court time shall be allowed to any such employee who has been notified that his/her presence is not needed, prior to the end of his/her shift, on the day preceding a scheduled Court appearance. If he/she is required to stay in attendance at such Court for more than four (4) hours, in any one (1) day, he/she shall be paid for the actual hours spent that day. Provided, however, that any and all fees, compensation or allowances, to which any employee, is or would be entitled to, for such court time, as provided for by statute or court order, shall be turned over and paid to the City, and not retained by the employee. No such Court time shall be considered overtime in computing his/her regular hourly rate.

A Member who is required to attend court during their annual leave and/or block of statutory holiday leave minimum of thirty hours) will be paid sixteen hours court-time for the first day of attendance and twelve hours for each subsequent consecutive day of attendance during their leave. For the purpose of this Article, annual leave shall include days off which precede, follow or are between the as booked. For this purpose, attendance at court or any proceeding relating to a Municipal, Provincial or Federal Statute including attendance as a Prosecutor'sAssistant, or as a witness in Provincial, District or Supreme Court or Coroner's Inquest or by Summons to Witness, on matters arising from the performance of police duties, but does not include any hearings under the Police Services Act or any court hearings in which a Member is charged with an offence. Any court hearing in which a Member is charged with any offence under Federal or Provincial Statutes during the legal execution of their duty, will be allowed to attend court as though it was their regular shift, such allowance will be at the discretion of the Officer-in-Charge. In the event the Member is not acquitted, they shall reimburse such time used to the Service. A Member attending court on their day off or after working the late night shift or any scheduled shift which extends beyond midnight shall be credited with six hours per appearance. COURT TIME PAY. Court or deposition time in excess of an employee's regularly scheduled eight (8) hour work day or requiring the employee's appearance on his/her regularly scheduled time off shall be paid at the rata of time and one half (1 ½) and shall be paid for two (2) hours’ time or the actual hours worked, whichever is greater. Compensation for court or deposition time shall be made in the form of monetary payment or as compensatory time off, as mutually agreed upon by the employer and the employee. If there is not agreement the employee shall receive monetary payment. Said. Court or deposition time must be relative to the employee's employment and related to an incident in which the employee was involved or otherwise assigned to while in the line of duty as prescribed by law. The required court appearance, whether civil or criminal in nature, shall be observed as court time and the employee shall be compensated accordingly, so long as said appearance is directly relative to an incident involving the employee while on duty. Any employee placed on "court standby" status relative to his/her employment with this department, during his/her regularly scheduled time off, and shall be compensated by the department for those hours on “standby” with respect to the following schedule: Hours on Standby Work hours accredited ½ hr. to 8 hrs. 2 hours 9 hrs. to 16 hrs. 4 hours 17 hrs. to 24 hrs. 6 hours This entitlement to standby pay shall be repeated in the same allocation for all subsequent standby hours after twenty-four (24) hours. Those hours accredited in accordance with the above rate shall refer to hours of pay at the employee's regular rate of pay, and shall be paid to the employee in the form of either monetary payment or as compensatory time off as mutually agreed. If compensatory time off is not mutually agreed to, employees shall be paid at his/her straight time rate. To be eligible for this entitlement, the employee shall have been ordered by, or received express approval of his/her superior to be in such "standby" status.
