Court Subpoena. (1) An employee shall be granted a paid leave of absence when he/she is subpoenaed. A copy of the subpoena shall be submitted to their immediate supervisor as soon as the date of the appearance is known. Immediately upon returning to duty, the employee shall report the absence in accordance with established procedures.
Court Subpoena. Court appearance as a witness in any case connected with the employee's employment at the school or whenever the employee is subpoenaed to attend any proceeding, except cases involving the employee's self-involvement in court proceedings, less per diem received for such proceedings.
Court Subpoena. An employee who is subpoenaed to appear as a witness in court in a criminal proceeding, during any work day, shall receive full compensation for the time absent from work. An employee subpoenaed by East Xxxxx County Schools to appear as a witness in court in a civil proceeding during any work day shall receive full compensation for the time absent from work. An employee subpoenaed by someone other than East Xxxxx County Schools to appear as a witness in court in a civil proceeding during any work day may receive full compensation for the time absent from work, at the discretion of the Superintendent. However, if the employee is subpoenaed by the Association in a suit against East Xxxxx County Schools, then the employee will receive no compensation for the time absent from work.
Court Subpoena. No salary deduction shall be made for absence when subpoenaed to be a witness in court.
Court Subpoena. If an employee is issued a court subpoena s/he shall continue to receive full salary less the amount of compensation, exclusive of reimbursable expenses paid to her/him for such service, provided this paragraph shall not apply in any matter to which the school district is a party and the Association and/or one of its affiliates is also a party, if the subpoena has been issued on behalf of a party adverse to the school district.

Court Subpoena – A teacher who is subpoenaed as a witness in a case (not related to their employment with the Board) may be granted unpaid leave for the period of time the teacher is unable to report to work. Written notice of the leave, to include a copy of the subpoena, must be provided to the teachers supervisor at least seven working days prior to the court date. A teacher may use personal leave, if available. The use of personal leave does not negate the need to provide the notice called for in this paragraph.

Court Subpoena. All administrators shall be charged a paid personal day when absence is necessitated because of a civil court subpoena. However, if the employee is subpoenaed to appear on behalf of a party adverse to the Board of Education in the pending litigation, there will be no charge to the employee. A copy of the subpoena shall be submitted along with a written request if the employee wished to be granted a leave without deduction of salary.
Court Subpoena. All administrators shall be granted leave, without deduction of salary, when absence is necessitated because of a civil court subpoena unless the employee is subpoenaed to appear on behalf of a party adverse to the Board of Education in the pending litigation or the employee is to appear as a paid witness in connection with private non-school business. A copy of the subpoena shall be submitted along with a written request if the employee wishes to be granted leave without a deduction of salary.
