COURT SERVICE. If an employee is required to appear in court or pursuant to a subpoena or other order of a court or body or to perform jury service, and such appearance or service results in his/her absence from work, he/she shall be granted court service leave for the period of time necessary to fulfill such requirement. Any employee who makes an appearance and whose service is not required shall return to work as soon as practicable after release. An employee on court service leave for a full day shall receive the difference between the payment received for such court service, excluding any travel allowance, and his/her regular pay. Any employee returning to work from court service leave shall be paid by the State for his/her actual hours worked or a minimum of the difference between payment received from the court, excluding any travel allowance, and his/her regular pay, whichever is greater. The provisions of this Article shall not apply to an employee summoned to or appearing before a court or body as a party to any private legal action which is not job related.

COURT SERVICE. The College recognizes that it is the civic duty of its faculty to participate in court service. Therefore, faculty members shall be paid their regular scheduled pay for the actual time served in court service.

The provisions of this Article shall not apply to an employee summoned to or appearing before a court or body as a party to any private legal action which is not job related.
COURT SERVICE. When any regular teacher is summoned to court in connection with public school affairs or in connection with cases in which the personal interests of that teacher are not involved, said teacher shall receive his/her regular school salary; however, he/she shall be required to remit fees received for court service to the School Department within ten (10) days of receipt of said fees. Such leave shall establish service credit as established in Section 5-5.

Therefore, bargaining unit members shall be paid their regular scheduled pay for the actual time served in court service. Court service is defined as a situation in which a bargaining unit member is summoned for jury duty or subpoenaed to appear before a court or other legally constituted body authorized by law to compel the attendance of individuals as a witness, except when the bargaining unit member is a party to a civil or criminal action. Any stipend pay to the bargaining unit member by the Court shall be retained by the bargaining unit member.

COURT SERVICE. An employee who is summoned for jury duty or who is appearing under a subpoena before a Court or an agency as a witness in a criminal or civil proceeding shall be granted all necessary leave. The employee’s compensation for said leave shall be with pay if the compensation received for the services performed, less transportation, is remitted to the Board.
COURT SERVICE. 6.15.1 A full-time, part-time or fixed term employee required to attend for jury or other service as subpoenaed by a court during his/her ordinary working hours will be reimbursed by NUAA an amount equal to the difference between the amount paid in respect of attendance for such court service and the amount of wages they would have received in respect of the ordinary time they would have worked had they not been on jury or other court service.
COURT SERVICE. The provisions of this clause will not apply, in the case of service of court documents, to the extent that such provisions are inconsistent with the Civil Procedure Rules.
