Court Appearance Time. Employees who are required to return to make court appearances at a time not contiguous to the beginning or end of their shift, shall be paid a minimum of two (2) hours at time and one- half (1½) for such required court appearances. In the event the employee is held beyond the guaranteed two (2) hour period, he shall be compensated at time and one-half (1½) to the nearest tenth (10th) for the period of time his presence is required by the court. The City reserves the right to implement a system whereby officers shall be required to contact the appropriate court liaison unit on the date of a scheduled court appearance for approval to attend. In the event this program is implemented, the officers shall be compensated for one (1) hour at the overtime rate for each date that a call is made and a court appearance is not required. When an appearance is required, compensation will occur as set forth in the preceding paragraph and the one (1) hour compensation will not result.

In the event the Officer is working the 11:00 p.m. to 7:00 a.m. watch, and spends more than five (5) hours in Court, he shall not be required to report to work if scheduled for that same day. However, the time will be charged against his sick leave and he must notify the Watch Commander.

If the employee spends more than two (2) hours in court, the employee shall be paid the one and one-half (1 ½) times their regular hourly rate for the total hours. The employee agrees to see that all witness fees are paid that the employee is entitled to and the employee agrees to turn such fees over to the City. Failure of the employee to apply for the witness fees shall result in the amount of the witness fee that would have been received being deducted from the applicable pay under the provisions of this section, excluding reimbursement for meal and/or mileage if applicable. The City agrees to provide a City vehicle for the employee to drive directly to and from any required court appearance, unless required to stop at any law enforcement agency.

No more than two (2) guaranteed minimums shall be paid in any one day. In the event two or more court appearance times are contiguous or overlap, only one (1) minimum guarantee shall apply. Should an actual appearance be required on a case, and the employee is not released in sufficient time to appear for subsequently scheduled cases, the subsequent cases shall not be subject to the minimum guarantee. In lieu of physically responding to a court location, employees may call to learn if an appearance will actually be required. If this is not known at the time of initial contact the employee may make arrangements with competent authority to call or be called at a later time to learn about appearance requirements.
