Court Appearance Leave. Leave shall be granted for appearance before a court, legislative committee, or other judicial or quasi-judicial body in response to a subpoena or other direction of proper authority for job related purposes other than those instituted by the employee or the exclusive representative. Leave shall also be granted for attendance in court in connection with an employee's official duty, which shall include any necessary travel time. Such employee shall be paid for the employee's regular rate of pay but shall remit to his/her Appointing Authority the amount received, exclusive of expenses, for serving as a witness, as required by the court. Unpaid leave shall be granted for other appearances before a court, judicial or quasi-judicial body in response to a subpoena.

Leave shall also be granted for attendance in court in connection with a supervisor's official duty, which shall include any necessary travel time. Such supervisor shall be paid the supervisor's regular rate of pay but shall remit to his/her Appointing Authority the amount received, exclusive of expenses, for serving as a witness, as required by the court.

Court Appearance Leave. An employee may request and shall be granted leave without pay for the time required to make an appearance as a plaintiff or defendant in a civil or criminal court proceeding that is not connected with the employee’s officially assigned duties. The request must be made at least thirty (30) days in advance of the appearance, except in the case of traffic citations, notice will be given the first work day after receipt of the citation.
Court Appearance Leave. Employees who are absent from work as a result of being subpoenaed as a witness in any court action, arbitration proceeding, or administrative proceeding, where neither the employee nor the Association are parties in a claim against the Board, shall be paid the difference between the court payment and his regular salary. The employee will receive his full daily wage from the Board by endorsing the witness payment to the Board. Employees who are absent from work as a result of being subpoenaed as a witness in any court action, arbitration proceeding, or administrative proceeding in which the employee is the sole party in a claim against the Board, shall receive no pay for the period of absence except as allowed with personal leave.
