Common use of Costs to Be Reimbursed Clause in Contracts

Costs to Be Reimbursed. The term Cost of the Work shall mean all costs necessarily and reasonably incurred by Construction Contractor in the proper performance of the Construction Phase Services portion of the Work. Such costs shall be at rates not higher than the standard paid at the place of the Project except with the prior written consent of Owner only after Construction Contractor has provided sufficient support in writing that exceptional circumstances exist, which justify the payment of rates higher than the standard. The Cost of the Work shall include only those items set forth below in this subsection A:

The Cost of the Work shall include only those items set forth below in this subsection A:

Such costs shall be at rates not higher than the standard paid at the place of the Project except with the prior written consent of Owner OWNER only after Construction Contractor CONSTRUCTION MANAGER has provided sufficient support in writing that exceptional circumstances exist, which justify the payment of rates higher than the standard. The Cost of the Work shall include only those items set forth below in this subsection ASubsection 6.1:

Costs to Be Reimbursed. § 6.1.1 The term Cost of the Work shall mean all costs necessarily and reasonably incurred by the Construction Contractor Manager in the proper performance of the Construction Phase Services portion of Work and properly charged against the WorkGuaranteed Maximum Price. Such costs shall be at rates not higher than the standard paid at the place of the Project except with the prior written consent of Owner only after Construction Contractor has provided sufficient support in writing that exceptional circumstances exist, which justify the payment of rates higher than the standardOwner. The Cost of the Work shall include only those the items set forth below in this subsection A:Sections 6.1 through 6.7. Costs of the Work that exceed the Guaranteed Maximum Price shall be borne by the Construction Manager.

Such costs shall be at rates not higher than the standard paid at the place of the Project except with the prior written consent of Owner only after Construction Contractor Design-Build Firm has provided sufficient support in writing that exceptional circumstances exist, exist which justify the payment of rates higher than the standard.
