Cost Increase by Mutual Agreement. After the contract’s initial term and if the Department agrees to a renewal, the parties may agree upon a cost increase. The Department is not obligated to agree upon a renewal or a cost increase. Any cost increases must be based on demonstrated industry-wide or regional increases in Contractor's costs. Publications such as the Federal Bureau of Labor Statistics and the Consumer Price Index (CPI) for all Urban Consumers may be used to determine the increased value.

The University is not obligated to agree upon a renewal or a cost increase. Increases in cost after the original contract term five (5) years shall be no greater than an amount equal to any percentage increase in the Contractor’s (documented) cost of goods for manufacturing such products during the immediately prior year. In no case, however, shall the increase be greater than a one-time 3% increase for final two renewal years combined.

Except as expressly set forth in the Associated Product Agreement, the terms and conditions governing the Associated Product Agreement are not affected by the termination of Your right to use the Program under this Agreement. The provisions of this Agreement that by their nature continue shall survive any expiration or termination of this Agreement.
