Controlled Unclassified Information. The parties understand that information and materials provided pursuant to or resulting from this cooperative agreement may be export controlled, sensitive, for official use only, or otherwise protected by law, executive order or regulation. The Cooperator is responsible for compliance with all applicable laws and regulations. Nothing in this cooperative agreement shall be construed to permit any disclosure in violation of those restrictions.
Controlled Unclassified Information. The nature and amount of the Controlled Unclassified Information to be acquired and disseminated pursuant to this Agreement shall be consistent with the objectives of this Agreement and the following guidelines and procedures:

Controlled Unclassified Information. There are types of information, that are not classified, that require application of controls and protective measures for a variety of reasons. This information is known as controlled unclassified information (CUI). This clause 5.A covers the definition of CUI and provides basic information about the nature of this information and the procedures for identifying and controlling it. The types of information considered CUI for the Future Combat Systems (FCS) program are "For Official Use Only" information and information contained in technical documents.

Controlled Unclassified Information. In the event that Seller performs Work for Company that involves MDA CUI, Seller shall abide by any conditions or restrictions of a Contractor Equivalent Background Check (CEBC) issued by MDA, which shall be deemed to be incorporated in the Contract by reference.
