CONTRACTING OUT SERVICES. No bargaining unit employee shall be laid off, displaced (except as noted below), demoted or suffer loss of pay or benefits as a result of the contracting of bargaining unit work. The City Manager retains the codified right to transfer employees, and management shall continue to assign work to meet the service needs of the City. The City will Meet and Confer with the Union prior to the initiation of the bidding process to contract out bargaining unit work. The Union agrees that it will cooperate with the City in determining the most efficient and effective ways to accomplish work processes. Notwithstanding the above agreement, if it is mutually agreed (by the Union, employee and City) that appropriate work within the City is not available for an employee as a result of contracting out of services and the employee is separated from service, the employee will receive a separation benefit of four (4) months pay in addition to the normal termination benefits applicable to other employees covered by this Agreement.

CONTRACTING OUT SERVICES. Where work is undertaken by GHCMA and it is proposed to be considered for contracting-out, the following procedures will be followed by GHCMA: • Identify and prioritise potential functions for contracting out • Establish communication channels between staff and management, refer to staff representatives. In conjunction with staff, establish an understanding of the procedures contained in government guidelines • GHCMA employees currently involved in providing the selected service shall detail the service as it currently operates including current outputs/levels of service, as well as an assessment of resources expended in performing the selected service • The Staff-Management Workgroup shall assist in examining options • Perform Cost Benefit/Risk Assessment or equivalent • Prepare a case to support the preferred option for future service delivery. This may include re-organisation within the business, development of an internal business unit, the mobilization of existing function/activity with no replacement, outsourcing or continuation as is. (i.e. status quo) • Seek the necessary approvals to proceed • Once a decision has been made by the GHMCA, relevant staff and staff representatives to be advised
CONTRACTING OUT SERVICES. The Union recognizes that the Employer has the obligation to provide effective health care in as efficient a manner as possible. The Employer recognizes that the Union has the obligation to protect the rights of Union members. AHS reserves the right to meet immediate day-to-day operational needs by contracting for services, for example, through registry, temporary services and similar temporary health agencies. Prior to any subcontracting that does not meet the definition of day-to-day operational needs, AHS shall provide a 15-calendar day notice to the Union of the proposal to subcontract. Said notice shall include all bargaining unit classifications impacted and justification for the proposed subcontracting which may be in the form of a proposal submitted by a possible contractor. Upon request of the Union, AHS shall meet with SEIU to meet to: Review the proposal and answer questions and concerns about the proposal. Explore how the Union might present a counter proposal that could be presented to the Board of Trustees for consideration and mutually explore other ways to avoid contracting out the service. Meet and confer over the impact of the contracting out proposal. This meet and confer can be delayed by mutual agreement of the parties until after the Board of Trustees considers and votes on a union counter proposal, or, in the absence of a counter from the Union, the proposed contract The Union reserves the right to present a position paper to the appropriate committee of the Board of Trustees. These meetings are to last no longer than 60 calendar days after which the Board of Trustees can make a final decision on contracting out the service.
CONTRACTING OUT SERVICES. The Employer may determine to contract or subcontract work, provided that as to work which that is presently and regularly performed by employees in the bargaining unit, the Employer agrees to provide the Union with the opportunity to bid on such work that is being considered for contracting out in accordance with the model they have mutually developed. The Employer further agrees to negotiate, upon demand, the impact of the pending action on bargaining unit employees. It is specifically understood that the provisions of this paragraph shall apply when the contemplated contracting or subcontracting will result in the layoff of one or more employees, and that these obligations shall not apply where the impact is minimal. The severance benefit available to employees displaced as a result

It is specifically understood that the provisions of this paragraph shall apply when the contemplated contracting or subcontracting will result in the xxxxxx of one or more employees, and that these obligations shall not apply where the impact is minimal. The severance benefit available to employees displaced as a result of contracting out is set forth in Appendix E, Section D.3 (Contracting Severance Benefit). Employees who are displaced from the bargaining unit as a result of merger, joint venture or any other form of collaboration between the Employer and a third party, and who are not offered a position in a classification with similar job duties by way of a bona fide offer letter in the merged, joint venture or collaborative entity, will also be eligible for this severance benefit.
