CONTRACT COVERAGE. Section One. This Agreement shall pertain only to those employees whose job titles fall within Certification SE-5971 or by mutual Agreement of the parties and shall not apply to non-permanent employees appointed to nonpermanent temporary, emergency or seasonal positions, nor to durational positions of six (6) months or less. Employees appointed originally on a provisional basis, and/or employees appointed to durational positions established for six (6) months or more shall be covered by this Agreement, but shall have no right of appeal from termination due to expiration of position or failure to successfully complete the required examination and appointment process. Persons serving a Working Test Period are not excluded except as otherwise indicated in this Agreement.

CONTRACT COVERAGE. This contract provides protection, at a reasonable cost, against breakdown of specific items you have due to normal wear and tear. This agreement is not intended to replace responsibility for minor repairs or normal maintenance. It does not cover everything. It may not cover the entire cost of repair or replacement of a covered item. A deductible is required for each APHW covered repair. Please read the following terms and conditions carefully. They describe the terms of your coverage and how to obtain service. THIS CONTRACT COVERS ONLY THOSE ITEMS WHICH ARE:
CONTRACT COVERAGE. The parties agree that the terms of this Agreement apply only to full-time employees. Part-time employees, durational employees and substitutes shall be covered by the terms of the Supplemental Agreement which is attached hereto.
CONTRACT COVERAGE. When Floater appointees are assigned to title codes covered by this contract, they are covered by the following Articles of this Agreement: Access, Agreement, Duration, Health and Safety, Holidays, Hours of Work, Management Rights, Military Leave, Nondiscrimination in Employment, No Strikes, Parking, Payroll Deduction, Personnel Files, Positions, Reasonable Accommodation, Severability, Shift Differential, Sick Leave, Uniforms, Vacation, appropriate sections of Wages, Waiver, Work-Incurred Injury or Illness, and Work Rules. Floater Appointees may use the grievance and arbitration procedures of this Agreement only to the extent provided in the applicable portions of the Articles identified in this Section.

During the term of this agreement neither party shall be required to negotiate with respect to any such matter whether or not covered by this agreement and whether or not within the knowledge or contemplation of either or both of the parties at the time they negotiated or executed this agreement. Any employee who resigns from the employment of the Board of Education shall give, in writing, 60 days notice of such. The Board of Education must give, in writing, 60 days advance notice in the termination of an employee covered under this contract.

CONTRACT COVERAGE. Replacement employees shall be issued a non-continuing individual contract for the term of the leave. Replacement employees shall be entitled to all coverage of all the terms and conditions of this Agreement, except Article V, Reduction In Force.
CONTRACT COVERAGE. Coverage under this Contract is limited to the repair, or if not repairable, the replacement of damaged original equipment tires and/ or wheels, as well as new tires installed (mounted on the covered wheels) on the Covered Vehicle during the term of the Contract, provided the damage is caused by a covered road hazard and there is more than 2/32” of tread on the tire, up to the Program and Coverage limits selected by the Contract Holder. Original equipment is defined as the wheels and tires installed on the vehicle at the time of purchase/delivery, including wheel and tire packages approved by the vehicle manufacturer and the selling dealer as an upgrade option to the standard equipment. Wheels installed by the customer, the dealer, or any other facility or person after the date the vehicle was purchased/delivered that are not replacement wheels authorized by the Administrator are considered aftermarket wheels and are specifically excluded from coverage. Installation of aftermarket wheels voids all benefits and coverage of this Contract. This coverage applies only to the original purchaser of the vehicle identified on the Contract unless the original purchaser completes the transfer process with the Administrator. WHAT IS ROAD HAZARD DAMAGE? Road hazard damage is damage that occurs when a tire or wheel fails as a result of a puncture, bruise, or impact break incurred during the course of driving in a legal manner on a road maintained by state or local authority. Nails, glass and potholes are the most common examples of road hazards. FLAT TIRE REPAIR: This Contract covers the cost of flat tire repair up to $30.00 per tire, per occurrence. Coverage remains in effect for the repaired tire for the remaining coverage term, or until there is 2/32” or less tread, or until the Aggregate Limit of the Contract is reached, whichever occurs first. It is not necessary to contact the Administrator before having a flat tire repaired. TIRE REPAIR / REPLACEMENT: This Contract covers the costs to repair or replace a covered tire with more than 2/32” of tread remaining. The tire will be replaced if it can no longer hold air and cannot be safely repaired per Tire Industry Association (TIA) and/or Rubber Manufacturers Association (RMA) repair guidelines. The tire will be replaced, including mounting and balancing, and applicable taxes, in amounts not to exceed selected Tire Component coverage. An allegation that a Floater Appointee has been utilized in a manner inconsistent with Section E.1.a, Section E.2.e and/or Section 3 of this Positions Article shall be grievable and arbitrable. Teamsters Local 2010 shall have the burden of proof to show floater use that is inconsistent with Section E.1.a., Section E.2.e, and/or Section 3.
