CONTINUING UNLIMITED GUARANTY. This Section (“Continuing Unlimited Guaranty”) applies to each person who signs this Agreement as a Guarantor (each a “Guarantor”). To induce us to enter the Agreement, each Guarantor jointly and severally guarantees the prompt and full payment of all Obligations (defined below) when due.
CONTINUING UNLIMITED GUARANTY. The provisions contained in Sections 10 through 16 below (collectively, “Continuing Unlimited Guaranty”) apply to each person who signs this Agreement as a Guarantor (each such person, a “Guarantor”).
CONTINUING UNLIMITED GUARANTY. (a) Guarantor irrevocably, absolutely and unconditionally guarantees to Administrative Agent and each of the other Secured Parties the prompt, complete and full payment when due, and no matter how the same shall become due, of all Guaranteed Indebtedness. Without limiting the generality of the foregoing, Guarantor’s liability hereunder shall extend to and include all post-petition interest, expenses, and other duties and liabilities of Borrower described above in this subsection (a), or below in the following subsection (b), which would be owed by Borrower but for the fact that they are unenforceable or not allowable due to the existence of a bankruptcy, reorganization or similar proceeding involving Borrower.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, XXXXXXXXX XXXXXX ("Guarantor") absolutely and unconditionally guarantees and promises to pay to NORTH COUNTY BANK ("Lender") or Its order, on demand, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of U.S. LABORATORIES, INC. ("Borrower") to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, XXX XXXXXX (“Guarantor”) absolutely and unconditionally guarantees and promises to pay to U.S. Bank National Association (“Lender”) or its order, on demand, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of NUTECH DIGITAL, INC. (“Borrower”) to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, CENTRAL CITY VENTURE, LLC ("Guarantor") absolutely and unconditionally guarantees and promises to pay to COLORADO BUSINESS BANK ("Lender") or its order, in legal tender of the United States of America, the indebtedness (as that term is defined below) of CC TOLLGATE LLC ("Borrower") to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, MARC PULEO ("Guarantor") absolutely and unconditionally guarantexx xxx xxxmises to pay to SouthTrust Bank ("Lender") or its order, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of PET MED EXPRESS, INC. ("Borrower") to Lender in the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, XXXXX X. XXXXXXXXXXX ("Guarantor" absolutely and unconditionally guarantees and promises to pay to MASCOMA SAVINGS BANK, fsb ("Lender") or its order, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of ASCUTNEY MOUNTAIN RESORT, L.P. and ASCUTNEY MOUNTAIN RESORT HOTEL, L.P. ("Borrower") to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, American Eco Corporation ("Guarantor") absolutely and unconditionally guarantees and promises to pay to First National Bank of Ohio ("Lender") or its order, on demand, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of Chempower, Inc. ("Borrower") to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
CONTINUING UNLIMITED GUARANTY. For good and valuable consideration, American Electric Technologies. Inc. (“Guarantor’) absolutely and unconditionally guarantees and promises to pay to JPMorgan Chase Bank, NA (“Lender”) or its order, in legal tender of the United States of America, the Indebtedness (as that term is defined below) of M & I Electric Industries, Inc. (“Borrower”) to Lender on the terms and conditions set forth in this Guaranty. Under this Guaranty, the liability of Guarantor is unlimited and the obligations of Guarantor are continuing.
