Continuing Right. All agreements and obligations of the Company included herein shall continue during the period Indemnitee is a director, officer, employee or other agent of the Company and shall continue thereafter as long as Indemnitee is subject to any possible claim, action, suit, proceeding or any arbitration or other alternative dispute resolution mechanism, whether civil, criminal, administrative or investigative, by reason of the fact that Indemnitee was serving in the capacity referred to herein. For the avoidance of doubt, such agreements and obligations shall apply to any period prior to the date of this Agreement on the same basis as to periods from and after such date.

Continuing Right. AT&T will have the continuing right to market and sell the Service and any other communications services to any third parties, including but not limited to current, future and potential End Users, and to communicate with such third parties, including but not limited to with respect to Customer's performance hereunder.
