Continuation of Work. Pending the resolution of any dispute or claim pursuant to this Article 11, the Parties agree that performance of all obligations will be pursued diligently.
Continuation of Work. Pending the final resolution of any Dispute arising under, related to, or involving this Agreement, Contractor agrees to diligently proceed with the performance any Work under Dispute in accordance with the provisions of this Agreement and the JBE’s instructions. Contractor’s failure to diligently proceed with performance in this manner will be considered a material breach of this Agreement.

Pending the final resolution of any dispute arising under, related to, or involving this Agreement, Criteria Architect agrees to diligently proceed with the performance of this Agreement, including the delivery of deliverables or providing of Services, in accordance with the Judicial Council’s instructions. Criteria Architect’s failure to diligently proceed in accordance with the Judicial Council’s instructions will be considered a material breach of this Agreement.
Continuation of Work. Pending the resolution of any dispute or claim pursuant to this Article, the Parties agree that performance of all obligations shall be pursued diligently in accordance with the direction of the PHS signatory.
Continuation of Work. Pending final resolution of any controversy, dispute or difference, the Parties shall continue to fulfill their respective obligations under this Contract.
Continuation of Work. Pending the final resolution of any Claim, Contractor shall proceed diligently with the performance or provision of the Work and its other duties and obligations and Owner shall continue to compensate Contractor as set forth under this Agreement without diminution of effort; provided that Contractor is being compensated for the Work pursuant to the terms of this Agreement, including but not limited to the provisions of Article 8 and provided that the Parties agree that such duties and obligations can be safely and prudently performed.
Continuation of Work. Unless otherwise directed by Owner Parties, Contractor shall continue to diligently prosecute the Work while any Claim is pending.
Continuation of Work. Design-Builder shall continue to perform the Work and Owner shall continue to satisfy its payment obligations to Design-Builder pending final resolution of any dispute or disagreement.
Continuation of Work. Pending final resolution of any dispute, the parties shall continue to fulfill their respective obligations under this Agreement; provided, however, that the Owner may withhold any amount which is the subject of dispute from any payment otherwise due hereunder during the pendency of any dispute resolution proceeding. If the Administrator prevails in such dispute, the Owner shall immediately pay to the Administrator the unpaid amount in dispute with interest thereon, which interest shall accrue, at the Reference Rate, for each day from and including the date on which such amount was originally due to, but excluding, the date of actual payment thereof.
Continuation of Work. Pending the resolution of any dispute or claim pursuant to this Article, the Parties agree that performance of all obligations shall be pursued diligently in accordance with the direction of the NGA signatory.
