Consumer Accounts. If we do not complete a transaction to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. Our sole responsibility for an error in a transaction will be to correct the error and in no case will we be liable for any indirect, special, incidental, or consequential damages. In states that do not allow the exclusion or limitation of such damages, our lability is limited to the extent permitted by applicable law. The Credit Union will not be liable for the following: If, through no fault of ours, you do not have sufficient funds in your account to complete the transaction, your account is inactive, or the transaction would exceed the credit limit on your line of credit, if applicable. If you used the wrong account or Password, you have not properly followed any applicable service or Credit Union user instructions for making eBanking, Xxxx Pay, and Mobile transactions. If your personal computer malfunctioned or the phone lines were not working properly or the Credit Union computer system was not working properly and such problem(s) should have been apparent when you attempted your transaction. If circumstances beyond our control (such as fire, flood, telecommunication outages or strikes, equipment or power failure) prevent making the transaction. If the funds in your account are subject to an administrative hold, legal process or other claim. If you have not given the Credit Union complete, correct and current instructions so the Credit Union can process the transaction. If, through no fault of ours, a Xxxx Pay, Online Banking or Mobile eBanking transaction does not reach a particular payee due to changes in the payee address, account number or otherwise; the time you allow for payment delivery was insufficient; payment is lost in the mail or the payee failed to process a payment correctly or in a timely manner and a fee, penalty, or interest charge is assessed against you. If an error was caused by a system beyond the Credit Union's control, such as a telecommunications system, an Internet Service Provider, any computer virus or problems related to software not provided by the Credit Union If there are other exceptions as established by the Credit Union.
Consumer Accounts. This paragraph applies only to Eligible Transaction Accounts used for personal, family and household purposes, and shall not apply to the Small Business Transfers Service. Immediately following your discovery of an unauthorized Transfer Instruction, you shall communicate with customer care for the Account to Account Transfer Service in the manner set forth in Section 12 (Notices to Us Regarding the Account to Account Transfer Service) above. You acknowledge and agree that time is of the essence in such situations. If you tell us within two (2) Business Days after you discover your password or other means to access your account through which you access the Account to Account Transfer Service has been lost or stolen, your liability is no more than $50.00 should someone access your account without your permission. If you do not tell us within two (2) Business Days after you learn of such loss or theft, and we can prove that we could have prevented the unauthorized use of your password or other means to access your account if you had told us, you could be liable for as much as $500.00. If your monthly financial institution statement contains transfers that you did not authorize, you must tell us at once. If you do not tell us within sixty (60) days after the statement was sent to you, you may lose any amount transferred without your authorization after the sixty (60) days if we can prove that we could have stopped someone from taking the money had you told us in time. If a good reason (such as a long trip or a hospital stay) prevented you from telling us, we will extend the time periods specified above to a reasonable period.

The Credit Union will not be liable for the following: • If, through no fault of ours, you do not have enough money in your account to make the transfer, your account is inactive, or the transfer would exceed the credit limit on your line of credit. • If you used the wrong access code or you used an access code in an incorrect manner. • If the card has expired or is damaged and cannot be used. • If the ATM where you are making the transfer does not have enough cash. • If the ATM or POS terminal was not working properly and you knew about the problem when you initiated the transaction. • Circumstances beyond our control (such as fire, flood, or power failure) prevent the transaction. • If the funds in your account are subject to legal process or other claim. • If your account is frozen because of a delinquent loan. • If the error was caused by any of the designated ATM networks’ systems. • If you have not given the Credit Union complete, correct, and current instructions for us to process a transfer or bill payment. • If, through no fault of ours, a bill payment or funds transfer transaction does not reach a particular payee due to changes in the payee address, account number, or otherwise; the time you allow for payment delivery was inaccurate; the payee failed to process a payment correctly or in a timely manner; and a fee, penalty, or interest is assessed against you. • If the error was caused by a system beyond the Credit Union’s control, such as a telecommunication system, an Internet service provider, or any virus or problems related to software not provided by the Credit Union. • If there are other exceptions as established by the Credit Union. • If the ATM retains your card under certain circumstances, in which event you may contact the Credit Union about its replacement.

If you permit other persons to use an EFT service, Card or access code, you are responsible for any transactions they authorize or conduct on any of your accounts. However, tell us at once if you believe anyone has used your Account, Card or access code and accessed your accounts without your authority. Telephoning is the best way of keeping your possible losses down. For MasterCard Check Card purchase transactions, if you notify us of your lost or stolen card, you will not be liable for any losses provided you were not grossly negligent or fraudulent in handling your Card and you provide us with a written statement regarding your unauthorized Card claim, otherwise the following liability limits will apply. Consumer Accounts. Any owner of a joint account may access the account by applying for and using the Service, and we are not required to provide prior notice to the other owner(s). Any owner may initiate and authorize a payment or transfer and we may act on that authorization. Accounts (a) which require the signature of more than one individual for transactions, or (b) for which you are only an authorized signer but have no ownership rights, do not qualify for use via the Service. The Bank reserves the right to determine whether an account is eligible to be accessed via the Service.

Consumer Accounts. Access to Electronic Services is set at an individual level. Owners, joint owners, and custodians on the accounts should register using their own unique information to create unique login credentials. Except as expressly provided in subsection (b) below, you understand that all owners of your accounts or anyone with whom you share your username, password, or any access code (“Credentials”), will be deemed an authorized user; and that their authority will be considered unlimited in amount and manner, with full authority to perform all transactions relating to the stated accounts, unless and until you notify the Credit Union, in writing, of the revocation of such authority. Except as may otherwise be required by law, you agree that you are and will remain fully responsible for any transactions made by such persons on your accounts, except transactions that occur after the Credit Union has been notified of any revocation of authority and has had a reasonable opportunity to act upon such notice.

Individual Ownership. The Account is owned only by the primary Account holder shown on the Application. No other person has any present rights in the Account. The Account is owned by the primary Account holder and one or more additional individuals identified on the Application as joint owner(s), together referred to as owner. Under joint ownership, the Account is owned jointly and is subject to the right of any owner as stated in this MSA and Other Agreements. We are authorized to pay funds to, or to transact any Business with, any owner. However, only the owner who is the primary Account holder can close an Account in its entirety. The primary Account holder must also be the primary applicant on all loans under the Account. Any owner may make deposits and each owner appoints the other owners as attorney-in-fact with the power to deposit any deposit payable to any one, or more, owners and, for that purpose, to endorse any withdrawal item payable to any one, or more, owners. All owners agree that any owner may initiate the withdrawal or transfer of funds and may obtain additional Services without further consent of the other owners. Owners are jointly and severally liable for payment of all charges against the Account, even when only one owner created the charge or otherwise benefited from it. One owner cannot remove another from the ownership (title) of the Account.
