Consumables Warranty. Except as specified in conditions 8.2 and 8.3, Consumables purchased from Kodak carry Kodak’s limited warranty that such Consumables will conform to published specifications for the period of time listed on the product packaging, provided the Consumables are used according to such specifications. In the event of any claim by Xxxxxxxx, Kodak’s liability shall be limited, at Kodak’s option, to replacement of the Consumables that are the subject of the claim or refunding the cost of such Consumables. All Consumables shall be validated and verified with Kodak before their intended use.
Consumables Warranty. Miraclon warrants that at Delivery, and for a period of two (2) months after Delivery, the Consumables will conform to their specifications, provided that they are stored and used in accordance with such specifications. In the event of any claim by the Customer, Xxxxxxxx’s liability shall be limited, at Miraclon’s option, to (i) replacement of the Consumables that are the subject of the claim or (ii) refunding the cost of such Consumables. There are no warranties on Consumables such as filters and light bulbs.
Consumables Warranty. Consumables that, upon receipt by an HP Customer, are found to be defective and unusable (Dud on Arrival or "DOA"), and which are promptly returned to Indigo by HP, will be replaced by Indigo at no charge to HP. No warranty is provided for the performance or yield of any Consumables. Solely for purposes of this paragraph, those parts that are routinely replaced by the OEM Printer operator (defined by Indigo as Operator Maintenance Parts (OMPs)) shall be deemed to be Consumables.
Consumables Warranty. Supplier represents and warrants that all (A) Customer Libraries shall be free from material defect and conform with the applicable Consumables Specification for [****] and (B) Other Consumables shall be free from material defect and conform with the applicable Consumables Specifications for a period of [****]. The foregoing warranty shall not apply to any Consumables (i) that are handled, stored, modified or used by Customer other than in accordance with the System Documentation, Consumables Documentation and Supplier’s written protocols, procedures, technical bulletins and other correspondences which have been agreed to by the Steering Committee, or (ii) in respect of which the nonconformance resulted from Customer’s upstream or downstream usage of the Consumables (outside of what otherwise is normal contemplated use), including, but not limited to, using single-use Consumables more than once. The parties will use commercially reasonable efforts to [****] and will in good faith correspondingly modify the applicable Library Specifications and the warranty period under Section 1.b.(ii)(A). Also, the parties will in good faith establish the Functional Performance Specifications of the Library Specifications [****] of first delivery of Customer Library to Customer.
Consumables Warranty. Haemonetics warrants that the Consumables when delivered F.O.B. Haemonetics’ place of shipment (a) are free from material defects in material and workmanship, and (b) have been manufactured in a manner consistent with the United States Food and Drug Administration’s current Good Manufacturing Practices. These warranties apply until the labeled expiration date. THE EXPRESS WARRANTIES IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER WRITTEN, ORAL OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 4.3
Consumables Warranty. For a period of ninety (90) days from the date of shipment, unless otherwise indicated on applicable packaging, the Consumables shall conform to the applicable specification. In the event of breach of this warranty, Desktop Metal will, at its sole cost, replace the defective consumable with a replacement consumable that conforms to the applicable specification. Customer is responsible for all shipping costs associated with returning defective Consumables to Desktop Metal; provided, however, that if Desktop Metal determines that the Consumables are eligible for warranty coverage, Desktop Metal will pay the shipping costs associated with shipping the repaired or replacement Consumables to Customer.
Consumables Warranty. ABAXIS warrants that the Consumables conform in all material respects to the package insert for the Consumables until the expiration date marked on the Consumables and/or the Consumables packaging (the “Consumables Warranty Period”). This limited warranty does not cover the results of accidents (including unusual physical stress), abuse, neglect, vandalism, use contrary to handling or operating instructions supplied by ABAXIS, or modification by anyone other than ABAXIS or an agent of ABAXIS.
