Consultation and Coordination. The parties will ensure they consult with each other whenever needed for the coordination of the activities of the team, including, but not limited to: — the review of the progress achieved and the performance of the team — the timing and method of intervention by the investigators — the best manner in which to undertake eventual legal proceedings, consideration of appropriate trial venue, and confiscation.

City Community Development staff and authorized Developer representatives shall communicate and consult informally as frequently as is necessary to ensure that the formal submittal of any documents to Authority and/or City can receive prompt and thorough consideration. Authority shall designate a City Community Development staff member to serve as the project manager for this Project and who shall be responsible for the coordination of Authority’s activities under this Agreement and for coordinating the permitting process.

During the Design Review Process, staff of the City and the Developer shall hold joint progress meetings to coordinate the preparation of, submission to, and review of the Design Review Submittals by the Director and the City. The City shall designate a City employee to serve as the City’s project manager who is responsible for the coordination of the City’s activities under this Agreement and for coordinating the land use approval and permitting process with the Developer’s representatives and consultants.

A Fitness for Duty Evaluation is a forensic evaluation completed by a specially trained psychologist, psychiatrist, outside the EAP, for the purpose of evaluating an employee’s ability to safely perform the functions of their job, assess organizational and behavioral risk, and provide a report recommending steps needed to be taken to minimize Group risk in returning the employee to work. Fitness for Duty Evaluations are outside the scope of EAP, and as such the EAP does not conduct Fitness for Duty Evaluations. Upon specific request, the EAP may assist Group with locating companies or providers external to the EAP who are capable of performing FFD Evaluations. At all times the Group is responsible for working directly with the identified FFD provider as well as directly making payment arrangements with that provider for the FFD Evaluation. All decisions, regarding returning to work, retaining or dismissing employees remain with the Group.
Consultation and Coordination. Under section 4(f) of the Endangered Species Act (ESA), 16 U.S.C. §§ 1531 et seq., the Secretary of the Interior is directed to develop and implement plans for the conservation of endangered species. The Secretary of the Interior may enlist the services of public and private agencies, individuals and Memorandum of Agreement for the Middle Rio Grande Endangered Species Collaborative Program 5/15/2008 institutions, including Program signatories, in developing and implementing such recovery plans. Advice from such agencies, individuals, and institutions, such as that offered by Program signatories, is not subject to the Federal Advisory Committee Act, 5 U.S.C. app. 2. The Program does not create an agency, board, commission, or any other entity of state government, nor does the MOA create a state advisory committee subject to Section 9-1-9 NMSA 1978.
