Consultant Requirements. Without limiting Consultant’s confidentiality obligations under the Agreement, Consultant shall be responsible for establishing and maintaining an information security program (including any relevant subcontractors) that is designed to: (i) ensure the security and confidentiality of Purchaser’s data; and (ii) protect against any threats or hazards to the security or integrity of Purchaser’s data; and (iii) protect against unauthorized access to or use of Purchaser’s data; and (iv) ensure the proper deletion of Purchaser’s data; and (v) ensure that all Consultant’s subcontractors, if any, comply with the foregoing. If Consultant’s information security system is breached, Consultant must timely notify Purchaser of such breach via e-mail and phone call. The minimum information security requirements will be incorporated into this Agreement as “FirstEnergy Security Requirements for Application Service Providers” and will be a material obligation of Consultant in its performance of the Work.
