Common use of Construction Plans Clause in Contracts

Construction Plans. On or before fifteen (15) days after approval of the Space Plan, the Design and Color Scheme and the Above Standard Product Specification List by Landlord and Tenant, Landlord's space planner and engineer, at Tenant's expense, will prepare construction plans (such construction plans, when approved, and all changes and amendments thereto agreed to by Landlord and Tenant in writing, are herein called the "Construction Plans") for all of Tenant's improvements requested pursuant to the Space Plan, the Design and Color Scheme and the Above Standard Product Specification List (all improvements required by the Construction Plans are herein called "Tenant's Improvements"), including complete detail and finish drawings for partitions, doors, reflected ceiling, telephone outlets, electrical switches and outlets and Building standard heating, ventilation and air conditioning equipment and controls. Within ten (10) business days after construction plans are delivered to Tenant, Tenant shall approve (which approval shall not be unreasonably withheld) or disapprove same in writing and if disapproved, Tenant shall provide Landlord and Landlord's space planner and engineer specific reasons for disapproval. The foregoing process shall continue until the construction plans are approved by Tenant; provided that if Tenant fails to respond in any ten (10) business day period, Tenant shall be deemed to have approved the last submitted construction plans.

Construction Plans. Within ten fifteen (1015) business days after construction plans Construction Plans are delivered to TenantLandlord, Tenant Landlord shall approve (which approval shall not be unreasonably withheldwithheld or delayed) or disapprove same in writing and if disapproved, Tenant Landlord shall provide Landlord Tenant and LandlordTenant's space planner and engineer specific reasons for disapproval. The foregoing process shall continue until the construction plans Construction Plans are approved by Tenant; provided that if Tenant fails to respond in any ten (10) business day period, Landlord. Tenant shall be deemed pay Landlord a fee for the review of the Construction Plans by Landlord's engineers and architects ("Construction Plans Review Fee") equal to have approved the last submitted construction plansLandlord's reasonable actual out of pocket costs to such third party vendors.

Within ten three (103) business days after construction plans are delivered to Tenant, Tenant shall approve (which approval shall not be unreasonably withheld) or disapprove same in writing and if disapproved, Tenant shall provide Landlord and Landlord's space planner and engineer specific reasons for disapproval. Within five (5) business days after receipt of such specific reasons for disapproval, Landlord's space planner and engineer shall deliver revised Construction Plans to Tenant. The foregoing process shall continue until the construction plans are approved by Tenant; provided that if Tenant fails to respond in any ten three (103) business day period, Tenant shall be deemed to have approved the last submitted construction plans. If the construction plans are not approved in writing by both Landlord and Tenant on or before fifteen (15) business days after Landlord delivers the initial construction plans to Tenant, Landlord shall be entitled to terminate Landlord's obligations under this Work Letter by delivering written notice of such termination to Tenant.

Within ten three (103) business days after construction plans are delivered to Tenant, Tenant shall approve (which approval shall not be unreasonably withheld) or disapprove same in writing and if disapproved, Tenant shall provide Landlord and Landlord's space planner and engineer specific reasons for disapproval. Within five (5) business days after receipt of such specific reasons for disapproval, Landlord's space planner and engineer shall deliver revised Construction Plans to Tenant. The foregoing process shall continue until the construction plans are approved by Tenant; provided that if Tenant fails to respond in any ten three (103) business day period, Tenant shall be deemed to have approved the last submitted construction plans. If the construction plans are not approved in writing by both Tenant and Landlord on or before June 8, 1995, for any reason whatsoever, then each day after June 8, 1995 that the construction plans are not approved by Tenant shall constitute one (1) day of Tenant Delay.

On or before fifteen thirty (1530) days after approval of the Space Plan, the Design and Color Scheme and the Above Standard Product Specification List by Landlord and TenantEffective Date, Landlord's ’s space planner and engineer, at Tenant's expenseas part of the Allowance, will prepare and provide Tenant with a complete set of construction plans (such construction plans, when approved, and all changes and amendments thereto agreed to by Landlord and Tenant in writing, are herein called the "“Construction Plans"”) for all of Tenant's ’s improvements requested pursuant to the Space Plan, the Design design and Color Scheme color scheme and the any Above Building Standard Product Specification List (all improvements required by the Construction Plans are herein called "“Tenant's Improvements"’s Work”), including complete detail and finish drawings for partitions, doors, reflected ceiling, telephone outlets, electrical switches and outlets and Building standard heating, ventilation and air conditioning equipment and controls. Within ten three (103) business days Business Days after construction plans are delivered to Tenant, Tenant shall approve (which approval shall not be unreasonably withheld, conditioned or delayed) or disapprove same in writing and if disapproved, Tenant shall provide Landlord and Landlord's ’s space planner and engineer specific reasons for disapproval. The foregoing process shall continue until the construction plans are approved by Tenant; provided that if Tenant fails to respond in any ten three (103) business day Business Day period, then each day after such date that Tenant fails to provide a response shall be deemed to have approved the last submitted construction plansconstitute one (1) day of Tenant Delay.

Within ten five (105) business days Business Days after construction plans Construction Plans are delivered to Tenant, Tenant shall approve (which approval shall not be unreasonably withheld) or disapprove same in writing and if disapproved, Tenant shall provide Landlord and Landlord's ’s space planner and engineer specific reasons for disapproval. The foregoing process shall continue until the construction plans Construction Plans are approved by Tenant; provided that if Tenant fails to respond in any ten five (105) business day Business Day period, Tenant shall be deemed to have approved the last submitted construction plans.
