Construction Phases. The timeline for the construction and increase of the capacity of the JV Plant shall comprise two (2) phases: (i) at “Phase 1” the JV Plant shall reach a capacity of producing the JV Products from sugar cane syrup obtained from crushing of 1,000,000 (one million) ton of sugar cane per year; and (ii) at “Phase 2” the JV Plant shall reach a capacity of producing the JV Products from sugar cane syrup obtained from crushing of 2,000,000 (two million) tons of sugar cane per year.

Construction Phases. The Foothill Gold Line will officially break ground in December 2017. The first three years of the project will be spent relocating utilities, conducting pre-construction activities, hiring a design-build contractor and finalizing design. Major construction will start in 2020 and involve two construction phases: (1) relocating/rebuilding the freight/Metrolink systems and (2) building the light rail system. During the first major phase of the project, the construction will focus on relocating the existing freight/Metrolink systems to the southern portion of the shared rail corridor (except from Lone Hill Avenue in Glendora to Towne Avenue in Pomona, where they will be relocated to the northern half ). The relocation of the freight/Metrolink systems will need to be completed with minimal disruption to operations of these services and will include relocating the Claremont Metrolink Station along with rebuilding several freight bridges and improving all of the project’s 28 at-grade crossings. Once the relocation of the freight/Metrolink systems is complete, the construction of the Gold Line system will begin. This major phase will include all elements of the Gold Line light rail project - stations, tracks, communication and safety Work Plan 2017 2018 2019 system, parking facilities and much more. Construction Phases. Construction of the Combined Project and of the Town Project may be split into phases based upon availability of funds or other practical constraints. Upon completion of the design and cost estimates for both the County Project and the Town Project, the County and the Town will jointly decide on whether to construct the Combined Project under one construction contract or whether to do the Town Project in phases. That decision will be described in an Exhibit C to be added to this Agreement signed by the County Project Manager and the Town Project Manager, and for the Town, the Town Director of Finance. If the initial decision is to construct the Town Project in phases, any additional Town Project phases that are later to be constructed will be described in an Exhibit D and added to this Agreement. Additional phases can be added by adding additional exhibits labeled appropriately over the term of this Agreement. A construction phase can include both a County Phase and a Town Phase, or just a Town Phase.

Construction Phases. (a) Within sixty (60) days after the pricing of the Phased PID Bond corresponding to a given Construction Phase, the Developer shall obtain a certified bid for the Final Phase Costs for the corresponding construction phase, commencing with Construction Phase 1A. Within sixty (60) days of receipt of such certified bid, the Developer shall deposit into the applicable Subaccount the difference, if any, between the Final Phase Costs for the applicable Construction Phase and the balance of the applicable Subaccount. Once the balance of the applicable Subaccount equals or exceeds the Final Phase Costs for the corresponding construction phase and the Developer executes a construction contract, the Developer shall, without unreasonable delay, commence construction of the applicable construction phase. Notwithstanding the above, the Developer shall have no obligation to commence construction of a construction phase until the City’s final approval of the Design Plans for that Phase. After commencement of construction, the Developer shall have twelve (12) months to substantially complete construction of the applicable Phase. The Developer may draw on the applicable Subaccount upon providing a Draw Request to Escrow Agent in accordance with Section 4.7(1).
