Construction Phase Compensation. (a) The Design-Builder shall only be entitled to compensation for Construction Work to the extent such Construction Work has been authorized pursuant to an executed Work Package Authorization, the Amendment/NTP, or a subsequently issued Supplemental Agreement. (b) Compensation for such authorized Construction Work shall be as described in the applicable Work Package Authorization, the Amendment/NTP, or Supplemental Agreement; provided that in no event shall such compensation exceed the GMP established pursuant to the Amendment/NTP, or, if the Amendment/NTP has not yet been executed, the applicable Work Package Authorization; provided further that the foregoing limitation shall be subject to any changes to the applicable GMP established pursuant to a Supplemental Agreement in accordance with the requirements of the DBA. (c) Prior to execution of the Amendment/NTP, the Design-Builder shall not incur any costs for Construction Work except as the Authority may specifically authorize in an executed Work Package Authorization.

XXXX GUARANTEES THAT THE GMP IS THE MAXIMUM COMPENSATION THAT XXXX MAY BE ENTITLED TO FOR CONSTRUCTION PHASE, AND THAT THE GMP IS PREPARED AT THE XXXX’X RISK SUCH THAT XXXX SHALL NOT BE ENTITLED TO ANY ADDITIONAL COMPENSATION FOR THE CONSTRUCTION PHASE UNLESS OTHERWISE PROVIDED BY THE CONTRACT DOCUMENTS.
Construction Phase Compensation. 7.2.1. The Owner shall compensate the Contractor for Work performed following the commencement of the Construction Phase based upon the approved Schedule of Values. Before the first Application for Payment, the Contractor shall submit to the Owner a Schedule of Values allocated to various portions of the Work, prepared in such form and supported by such data to substantiate its accuracy as the Owner may require. This Schedule, unless objected to by the Owner shall be used as a basis for reviewing the Contractor's Applications for Payment. Where multiple buildings are under this single Agreement, a separate, detailed Schedule of Values must be provided for each building or phase of work within the Application for Payment..
Construction Phase Compensation. The portion of Contract Price applicable to the Construction Services shall be the aggregate of all approved GMP Amendments. The District shall pay the Construction Manager a Construction Fee in an amount not to exceed _______Percent (___%) of the Direct Construction Costs for services performed during the Construction Phase.

For Construction Manager’s performance of the Work and all Construction Phase Services in strict conformance with the Contract Documents, and subject to the GMP, Owner shall pay Construction Manager “Construction Phase Compensation” consisting of: Subcontract Costs, plus Reimbursable Expenses incurred in performance of Construction Phase Services and the Work, plus the Construction Phase Fee.
