CONSTRUCTION MANAGER AT RISK AGREEMENT. The City of Naples, a Florida municipal corporation, (“Owner or City”), whose mailing address is 000 0xx Xxxxxx Xxxxx., Xxxxxx, Xxxxxxx 00000 hereby contracts with Xxxxxx Infrastructure South Co., whose mailing address is 0000 Xxxxxxxx Xxxxxxxxx Xxxxxxx, Xxxxx 000, Xxxxxxx, XX 00000 (“Construction Manager” or “XXXX or FIRM”), a Florida corporation, to perform all work (“Work”) in connection with the management and construction of that certain construction of RFQ#23-001 “Beach Restoration and Water Quality Improvements (Beach Outfalls) – Construction Manager at Risk (XXXX) - RFQ" (“Project”), located at multiple locations within the City as specified on the plans said Work being set forth in the plans and specifications being prepared by GRAFT-USA Inc., f/k/a Xxxxxxxx Consulting Engineers, Inc., the Architect and/or Engineer of Record (“Design Professional”) and all other Contract Documents hereafter specified. Owner and Construction Manager, for the consideration herein set forth, agree as follows:

CONSTRUCTION MANAGER AT RISK AGREEMENT. THIS AGREEMENT, made and entered into this by and between THE DISTRICT BOARD OF TRUSTEES OF MIAMI DADE COLLEGE, FLORIDA, hereinafter called the Board or Tenant or MDC, and hereinafter called the CONSTRUCTION MANAGER or CM.
CONSTRUCTION MANAGER AT RISK AGREEMENT. In addition to reviewing and understanding the submittal requirements, it has reviewed the Construction Manager at Risk Agreement, attached hereto as Exhibit B and incorporated herein by reference, and agrees to be bound by its terms.

  • Construction Management Plan Contractor shall prepare and furnish to the Owner a thorough and complete plan for the management of the Project from issuance of the Proceed Order through the issuance of the Design Professional's Certificate of Material Completion. Such plan shall include, without limitation, an estimate of the manpower requirements for each trade and the anticipated availability of such manpower, a schedule prepared using the critical path method that will amplify and support the schedule required in Article 2.1.5 below, and the Submittal Schedule as required in Article 2.2.3. The Contractor shall include in his plan the names and resumés of the Project Superintendent, Project Manager and the person in charge of Safety.

  • Construction Management Landlord or its Affiliate or agent shall supervise the Work, make disbursements required to be made to the contractor, and act as a liaison between the contractor and Tenant and coordinate the relationship between the Work, the Building and the Building’s Systems. In consideration for Landlord’s construction supervision services, Tenant shall pay to Landlord a construction supervision fee equal to three percent (3%) of Tenant’s Costs specified in Section 7.

  • Construction Manager The individual, partnership, corporation, joint venture, or any combination thereof, or its authorized representative, named as such by the District. If no Construction Manager is used on the Project that is the subject of this Contract, then all references to Construction Manager herein shall be read to refer to District.

  • Construction Manager’s Fee The following shall be deemed included in the Construction Manager’s fee for services during the Construction Phase.

  • Construction Management Fee The Construction Management Fee for the Project shall be either a ☒Lump Sum or ☐Not-To-Exceed Fee of Fifty-One Thousand, Four Hundred Fifty-Six Dollars and Twenty-Three Cents ($51,456.23). NOTE: Allowances will be on a Not-To-Exceed basis. All unused funds will be returned to the School District at the time of construction closeout.   • CONSTRUCTION MANAGER’S SERVICES The services which the Construction Manager shall provide include, but are not limited to, those described or specified herein. The services described or specified shall not be deemed to constitute a comprehensive specification having the effect of excluding services not specifically mentioned.

  • FRAMEWORK AGREEMENT MANAGEMENT The Parties shall manage this Framework Agreement in accordance with Schedule 14 (Framework Management).

  • Construction Phase Services 3.1.1 – Basic Construction Services

  • Construction Administration Services The Engineer shall perform construction administration services during construction as necessary. Such services shall, as part of the services to be rendered for the Engineer's established fee, include as much of the Engineer's professional services and the services of the Engineer's consultants as the State deems necessary for the well-being of the project and efficient prosecution of the construction work, but shall not include the Engineer's undertaking continuous on-site observation of the work. If the Engineer fails to perform such duties in a conscientious and reasonable manner, the State may exercise its right to terminate this contract as hereinafter provided in Section T. Additionally, it is understood and agreed to by the Engineer and the State that the duties of the Engineer shall include, but not be limited to, the following services:

  • Construction Documents Phase Services 3.4.1 Based on the Owner’s approval of the Design Development Documents, and on the Owner’s authorization of any adjustments in the Project requirements and the budget for the Cost of the Work, the Architect shall prepare Construction Documents for the Owner’s approval. The Construction Documents shall illustrate and describe the further development of the approved Design Development Documents and shall consist of Drawings and Specifications setting forth in detail the quality levels and performance criteria of materials and systems and other requirements for the construction of the Work. The Owner and Architect acknowledge that, in order to perform the Work, the Contractor will provide additional information, including Shop Drawings, Product Data, Samples and other similar submittals, which the Architect shall review in accordance with Section 3.6.4.
