PM officially closes project with Real Estate SITE SURVEY Prior to the commencement of any installation, a certified installation team will conduct a site survey at the designated installation location(s). This team will be designated by WinStar NC&D and will be comprised of contractors, WinStar personnel, or a combination of both. The Site Survey Team will comply with the procedures described below. The Site Survey Team should always work in cooperation with the building engineer/manager while performing the site survey. These guidelines generally apply to rooftop installation or towers.
Construction Complete. The Construction shall have been completed substantially in accordance with the Plans and Specifications and all Applicable Laws, and the Improvements are ready for occupancy and operation in the ordinary course of Lessee's business. All fixtures, equipment, materials and other property contemplated under the Plans and Specifications to be incorporated or installed in the Leased Property shall have been incorporated or installed free and clear of all liens except for Permitted Liens.

The Government reserves the right to access any space within the building for the purpose of installing equipment including but not limited to Telephone and Data/Communications cabling. GSA shall coordinate, within reason, the activity of Government contractors in order to minimize conflicts with/disruption to other contractors on site. Access shall not be denied to authorized Government officials including, but not limited to, Government contractors, subcontractors or consultants acting on the behalf of the General Services Administration with respect to this specific project. By way of example and not in limitation of the foregoing, Government contractors or subcontractors shall coordinate with the lessor and its general contractor the use of elevators and the availability of electricity, access to such phase or portion and sequencing of the work to be performed by the Government. The lessor shall not be liable or responsible for and shall have no obligation to provide heating, air conditioning or other building services to the Government in connection to access with its early access to each phase (or portion thereof) unless the Government agrees to compensate the lessor therefor. If an extended completion schedule is proposed due to the complexity of any given phase or the availability of materials necessary to meet the requirements specified by the Government, the Lessor shall provide to GSA a written request explaining the rationale for the extension and any additional documentation supporting the need for additional time to complete the tenant improvements. The dates specified earlier in this subparagraph for the completion of tenant improvements shall not be extended unless the extension of the completion schedule is approved by the GSA, in writing. It will be the Government’s sole determination as to whether said extension shall delay rent commencement, or whether rent will commence as if the extension had not been granted.
Construction Complete. Landlord and Tenant hereby agree that construction of the Building was substantially completed in accordance with the terms of the Lease, that Tenant has fully accepted the Building and the Premises, and that Landlord has no further duty or obligation under the terms and provisions of the Lease with respect to the construction, equipping or delivery to Tenant of the Building or the Premises.
