Construction Commencement and Completion. The Construction Documents shall contain such provisions for the protection of COPR and STWC as COPR and STWC shall deem appropriate; shall provide that the construction of the respective Project shall commence on a date certain following and subject to satisfaction of all Legal Requirements necessary to commence construction; and shall also provide that any contractor shall complete construction within such time as COPR and STWC agree following the commencement of construction. All contractors shall, at a minimum, warrant their respective portions of the work to be performed to be free of defects for at least one year after the Completion Date.

Construction Commencement and Completion. The Company shall commence construction of the Project not later than sixty (60) days following the successful procurement of all Required Permits and governmental approvals, which is preliminarily estimated to be August 31, 2022, but that date is a preliminary estimate and is subject to change due to Permitted Delays. The preliminary estimated date for the New IDI Facility Completion Date is June 30, 2024, but that date is a preliminary estimate and is subject to Permitted Delays.
Construction Commencement and Completion. The Construction Documents shall contain such provisions for the protection of the Band and Great Lakes as the Band and Great Lakes shall deem appropriate; shall provide that the construction of the Initial Phase of the Project shall commence on NIGC Approval, following and subject to the granting of all approvals necessary to commence construction; and shall also provide that any contractor shall exert its best efforts to complete construction within such time as the Band and Great Lakes agree following the commencement of construction. If the Band decides to proceed with an expansion to the Final Scope of Work, Great Lakes and the Band shall proceed in good faith with construction of a permanent Facility in accordance with the Final Scope of Work, as modified under Section 3.3, with such construction to be completed no later than two years after the Commencement Date unless otherwise agreed by the Band, but subject to any delay caused by the Band's approval process. All contractors shall, at a minimum, warrant their respective portions of the work to be performed to be free of defects for at least one year after the Completion Date of the Initial Phase and Final Scope of Work, respectively.

If construction is not commenced within thirty-six (36) months of the execution of this Lease, this Lease shall terminate unless an extension of time is requested by the Lessee for good cause and agreed to by the Board. Subject to delays beyond the reasonable control of the Lessee, the Lessee shall substantially complete construction of the Facility and obtain a Certificate of Occupancy within twenty-four (24) months of the beginning of construction, unless an extension of time is requested by the Lessee for good cause and agreed to by the Board. All construction shall be conducted: (a) in accordance with Supplemental General Conditions attached hereto as Exhibit C; and (b) in such a way as to not disrupt the operations of the schools owned by the Board and located on property adjacent to the Leased Property (the “Schools”). The Board shall assign a project manager as its representative during the design and construction of the Facility who may inspect the Facility upon reasonable notice to Xxxxxx and participate in project meetings. In addition, the Board shall have the right to approve the project schedule. The parties shall negotiate a coordination agreement prior to the commencement of construction work to minimize disruption to the operations of the adjacent schools, assure the safety of the school populations and public at large, and enhance schedule performance and the productivity of field operations. Upon completion of construction, Exhibit A may be replaced with a map showing the exact coordinates for the location of the leased parcel and improvements made by Xxxxxx as mutually agreed by the Board and Lessee.

Construction Commencement and Completion. Upon satisfaction of the conditions set forth in Section 8.2.1, each applicable Developer Party shall promptly commence and pursue with all due diligence the construction of the applicable Phase VI Improvements in compliance with the applicable Plans; the rules, regulations and requirements of all Governmental Bodies having jurisdiction; and with the requirements of the local fire insurance rating organization. All Project Work (including all Unit Work) shall be done in a good and workmanlike manner and otherwise in compliance with Applicable Laws, the relevant Plans, the Construction Documents, and any relevant Construction Loan, and this Agreement. All Phase VI Project Work shall be fully complete by the applicable Construction Completion Date.

(a) Subject to Developer securing all necessary “Predevelopment” items as set forth in Exhibit B of Exhibit “B” hereof, if any, and subject to any extensions pursuant to Section 303 and/or 304 below, Developer estimates commencement of site work for the Project on or before the date as specified in Exhibit B of Exhibit “B” hereof, and will use commercially reasonable efforts to complete the Project on or before the date as specified in Exhibit B of Exhibit “B” hereof, subject in all respects to Force Majeure as described in Section 303 below. If the Project Developer fails to construct the Project substantially in conformance with the Final Project Documents associated with the Project or fails to operate the Project (as the same is defined in Section 507(c) below), the Village may, subject to Developer’s notice and cure rights provided herein, terminate this Agreement.
Construction Commencement and Completion. Construction of the Project shall commence and be completed within a consecutive eleven month period extending between November 1 and September 30. Lessee shall be required to commence its construction of the Project within sixty (60) days after approval of the Final Plans or sixty (60) days after execution of this Lease, whichever is later; provided that in no event shall construction of the Project commence during the month of October when the annual North Carolina State Fair is held (the sixty (60) day construction commencement requirement shall xxxxx during the month of October). Construction of the Project shall be deemed to have commenced when Lessee begins site grading or site preparation. Acceptance of the Project at completion will be subject to a final inspection by the State Construction Office, which shall include testing of all life safety issues. As used in this Lease, completion of construction of the Parking Improvements shall be deemed to have occurred when Lessee has obtained a letter of acceptance for the Project from the State Construction Office and written acknowledgment from DACS (the date of such letter of acceptance from the State Construction Office and written acknowledgement from DACS being referred to herein as the "Completion Date"). Upon the Completion Date, the Project and the Parking Improvements shall become the property of Lessor and Lessor shall thereafter own, maintain and repair the Parking Improvements without contribution from Lessee and Lessee shall have no further obligations to Lessor with respect to the State Fair Parking. Lessee shall provide DACS with as-built drawings of the Parking Improvements and any manufactures' warranties within ninety (90) days of the Completion Date.
