Common use of Consent of the Parties Clause in Contracts

Consent of the Parties. In the event of any dispute between the ---------------------- parties with respect to any matter covered by this Agreement, the parties shall first use their best efforts to resolve such dispute among themselves. If the parties are unable to resolve the dispute within 30 calendar days after the commencement of efforts to resolve the dispute, the dispute will be submitted to arbitration in accordance with Subsection 7.3 hereof.

Consent of the Parties. In the event of any dispute between the ---------------------- parties with respect to any matter covered by this AgreementAgreement or any of the agreements entered into in connection herewith, the parties shall first use their best efforts to resolve such dispute among themselves. In the event of any dispute after the date of this Agreement between the ---------------------- parties with respect to any matter covered by this Agreement, the parties shall first use their best efforts to resolve such dispute among themselves. If the parties are unable to resolve the such dispute within 30 calendar days after the commencement of efforts to resolve the such dispute, the such dispute will be submitted to arbitration in accordance with Subsection 7.3 hereofthis Section 17 (excepting always that either party may in its sole discretion institute legal action in any court to enjoin or obtain equitable relief with respect to any claim of violation or threatened violation of Sections 16.3, 16.4 or 16.7 of this Agreement).

If the parties are unable to resolve the dispute within 30 calendar days after the commencement of efforts to resolve the dispute, or within 30 calendar days after the Closing Date in connection with any dispute in the Adjustment Amount, the dispute will be submitted to arbitration in accordance with Subsection 7.3 Section 13.03 hereof.
