Interconnection Customer agrees to conform with all requirements of the safe harbor provisions specified in the IRS Notice, as they may be amended, as required to confer non-taxable status on some or all of the transfer of property, including money, by Interconnection Customer to Interconnected Transmission Owner with respect to the payment of the Costs of construction and installation of the Transmission Owner Interconnection Facilities specified in this CSA. Nothing in Interconnection Customer’s agreement pursuant to this Schedule L shall change Interconnection Customer’s indemnification obligations under Section 2.4.2 of Appendix 2 to the CSA.
