Confirmation of Defined Terms. Unless modified herein, all terms previously defined and capitalized in the Lease shall hold the same meaning for the purposes of this First Amendment.

Confirmation of Defined Terms. Unless modified herein, all terms previously defined and capitalized in the Lease shall hold the same meaning for the purposes of this Eighth Amendment. The Original Lease, as amended by the First Amendment, the Second Amendment, the Third Amendment, the Fourth Amendment, the Fifth Amendment, the Sixth Amendment, the Seventh Amendment and this Eighth Amendment, shall collectively be referred to herein as the “Lease”.

For the avoidance of doubt, on and after the Second Restatement Closing Date, (x) the Additional Term Loans made pursuant to this Agreement are hereby designated as, and for all purposes of the Loan Documents shall be deemed to be, “Term Loans” and “Loans” and (y) each Additional Term Lender is hereby designated as, and for all purposes of the Loan Documents shall be deemed to be, a “Term Lender” and a “Lender”. The Additional Term Loans shall be secured by identical collateral and guaranteed on identical terms as the Term Loans under the Restated Credit Agreement prior to giving effect to this Agreement

The Original Lease, as modified by the OE Letter, the First Amendment and this Second Amendment, shall hereinafter be referred to as the “Lease.”
