Common use of Conduct of the Arbitration Clause in Contracts

Conduct of the Arbitration. An arbitration conducted pursuant to this Article VI shall be administered by and held before the American Arbitration Association (“AAA”) in accordance with the laws of the State of New York and the AAA’s then current Commercial Arbitration Rules. Notwithstanding the foregoing, no pre-hearing discovery shall be permitted unless specifically authorized by the arbitration panel, provided, however, that unless the Parties agree otherwise, there shall be no pre-hearing depositions or interrogatories. Any hearing or authorized discovery shall take place in New York City, unless the Parties agree otherwise.
