Condition of Site a. Xxxxxx has had an opportunity to inspect the Site. Xxxxxx has determined that the Site is suitable for the Camper’s Camping Unit and accepts the Site in an “AS-IS”, “WHERE-IS” condition with all faults.
Condition of Site. The Contractor/Supplier acknowledges by the execution of this Contract that it has investigated and inspected the Site regarding its suitability for the performance or furnishing of the Work/Materials, and accepts the same “AS IS” “WHERE IS” and “WITH ALL FAULTS,” without any representation or warranty by the University with respect thereto.

Except as may be disclosed in the Agency’s Environmental Reports, the Agency has not received any notice or communication notifying it of the presence of surface or subsurface zone Hazardous Materials in, on, or under the Site, or any portion thereof, or any other violations of health, safety, pollution, or other laws, ordinances, rules or regulations, except as may be set forth in the environmental reports which the Agency has submitted to Developer prior to the Date of this Agreement. Except as may be disclosed by the Agency’s Environmental Reports, to the Best Knowledge of the Executive Director, there are no Hazardous Materials in, on or under the Site or portions thereof except as disclosed in the Agency Environmental Reports provided to Developer. Until the Applicable Closing, Agency shall, upon learning of any fact or condition which would cause any of the warranties and representations in this Section 206.1 not to be true as of such date, immediately give written notice of such fact or condition to Developer. Such exception(s) to a representation shall not be deemed a breach by Agency hereunder, but shall constitute an exception which Developer shall have a right to approve or disapprove if such exception would have an effect on the value and/or operation of the Developer Improvements.
