CONDITION OF APARTMENT. Residents acknowledge that the Apartment has been inspected prior to signing this Agreement, and that Residents have accepted the Apartment leased hereunder and are satisfied with the state of repair, operation, and condition thereof, including all present decorating, fixtures, and appliances in the Apartment. Residents were provided by Chateau a move-in inspection form for the purpose of noting any damages or deficiencies to the Apartment. Residents’ failure to provide such form to Chateau within forty-eight (48) hours of Residents’ taking possession of the Apartment shall constitute conclusive evidence that the Apartment was received and accepted by Residents in good condition, with no damages or deficiencies. The approval by any one of the Residents as to the condition of the Apartment at move-in or move-out may and shall be relied upon by Chateau as constituting the approval of all Residents who sign this Agreement.

CONDITION OF APARTMENT. By execution of this Lease, Tenant admits that the Apartment has been inspected by him and meets with his approval; that Tenant accepts the Apartment “AS IS”; and that Landlord has made no promises to decorate, alter, repair or improve the Apartment unless otherwise specified in writing by Landlord prior to Tenant’s obtaining possession of the Apartment. Taking of possession of the Apartment by Tenant shall be conclusive evidence that Tenant has received the Apartment in good condition, and as represented to him.

CONDITION OF APARTMENT. An Apartment Condition Form will be provided to you at the time that you move in to the Apartment. Within 5 days after you move in, you are required to return the Apartment Condition Form and notify us in writing of any claimed defects or damages in your Apartment. If you do not do so, you agree that the Apartment and the fixtures and appliances in the Apartment are in a clean, safe and good working condition and you will be responsible for any defects or damage that may exist on the Ending Date of the Lease. WITH THE EXCEPTION OF THE ITEMS SPECIFIED IN THE APARTMENT CONDITION FORM THAT YOU RETURN TO US, YOU ACCEPT YOUR APARTMENT, AND THE FIXTURES AND APPLIANCES IN YOUR APARTMENT, IN THEIR "AS-IS" CONDITION, WITH ANY FAULTS. WE MAKE NO EXPRESS WARRANTIES AND DISCLAIM ANY AND ALL IMPLIED WARRANTIES (OTHER THAN THE WARRANTY OF HABITABILITY) WITH REGARD TO YOUR APARTMENT AND THE FIXTURES AND APPLIANCES IN YOUR APARTMENT. You are responsible for the cost of all repairs made necessary by you, your guest(s) or any other person in violation of this Lease or by the negligent or careless use of the Apartment or any part of the Community including without limitation, damage from waste water stoppages caused by foreign or improper objects in lines serving the bathroom; damage to furniture, appliances, doors, windows or screens; damage from windows or doors being left open; and repairs or replacements to security devices necessitated by misuse or damage. You agree to pay us for making these repairs within ten (10) days after we send you an invoice. Except for ordinary wear and tear from normal usage, you are responsible to us for any damage to your Apartment and the furnishings provided in the Apartment. Your obligation to pay the cost of repairs described in this paragraph will continue after the Lease terminates.
CONDITION OF APARTMENT. Tenants will have the opportunity to examine the Apartment and record existing damage to the Apartment or the Furnishings (as defined below). There has been no representation as to the condition of repair of the Apartment by the Landlord, other than as expressed in this Lease. Tenants shall have seven (7) days after taking occupancy to: (i) complete and sign the move-in condition report and submit it to Landlord for review and signature; and (ii) notify Landlord, in writing, of any defects, needed repairs, or existing damage to the Apartment or the Furnishings, otherwise the Tenants are deemed to have received the Apartment and the Furnishings in good order and repair. The move-in condition report, attached as an addendum hereto, details the charges Landlord will apply upon Tenants’ vacation of the Apartment if Tenants fail to clean the Apartment as required by this Lease or have caused damage requiring repair or replacement within the Apartment. By signing the Lease, Tenants accept these charges as reasonable. Following Xxxxxxxx’s receipt of the move-in condition report, repairs that are required to protect the health and safety of the Tenants will be performed at the earliest practical time under the circumstances existing at that time. Xxxxxxxx is not responsible for completing repairs when circumstances beyond its control prevent such completion. By signing this lease, Tenants are jointly responsible for the cost of repair, replacement or cleaning of any item or part that any Tenant(s) damage, modifies or destroys (including the removal of window screens). Replacement costs include full, not depreciated, charges for new materials and labor. Tenants are responsible for any damage caused by their guests. All repairs/replacement will be accomplished by Landlord or its designee. The Apartment must be cleaned prior to moving out. Tenants are jointly responsible for damages caused or cleaning required. Damage and cleaning charges will be divided evenly among Tenants, unless Landlord reasonably determines which Tenant(s) is/are responsible for the damages or cleaning. Xxxxxxxx will inspect the Apartment and complete the move-out condition report with Tenants after they have vacated. Additional damage charges may result from these final inspections. If a Tenant disagrees with an assessed damage charge, they must submit an appeal, in writing, to Landlord within two weeks of receiving the bill. CONDITION OF APARTMENT. LESSEE has examined the apartment and acknowledges that except for the work LESSOR has agreed to do in the application or other in writing. LESSEE is satisfied with the present condition of the apartment and neither LESSOR or LESSEE”S agent have made any representations or promises concerning the physical condition except those specifically set forth in the Lease.
CONDITION OF APARTMENT. Xxxxxx has inspected the Premises, the fixtures, the grounds, building and improvements and acknowledges that the Premises are in good, clean and acceptable condition and are habitable. Upon vacating said Xxxxxxxx, Xxxxxx agrees to return said Premises in the same manner as it was received. No garbage or personal belongings may be left behind. All appliances, venetian blinds (if provided), carpeting (if provided), bathroom tiles, fixtures, etc. must be left in a clean and good condition before vacating. Landlord may use security deposit to recover costs to clean and repair damaged property and or fixtures to the apartment/building as well as to remove abandoned belongings and furniture from the apartment or any storage areas.

CONDITION OF APARTMENT. Tenant accepts fixtures, and the apartment as is with no warranties from the landlord. Within 48 hours after move in, Tenant shall notify the Landlord of any defects or damage, otherwise everything will be considered to be in clean, safe, and in good condition.
