Concession Operations. The City hereby grants Concessionaire a concession for the use of the Downtown Transit Center concession area as defined in attached Exhibit "A", consisting of one (1) page and incorporated herein by reference, for outdoor vending. The Concessionaire shall have the right to operate an outdoor food vending concession within this area in accordance with the Agreement.
Concession Operations. 7.1 The management, maintenance and operation of the Assigned Areas shall at all times be under the supervision and direction of a qualified, competent manager who shall at all times be subject to the direction and control of the Concessionaire.
Concession Operations. MAYSA shall have the first right to operate the concessions facility at the Stadium Facility for all VAHS soccer matches.
Concession Operations. The operation of accommodations, facilities, and services authorized by the Concession Contract will conform to the evaluation standards set forth in the Concession Contractor Review Program (Exhibit M) and this Operating Plan.
Concession Operations a. In the event Manager fails to continuously provide Concession Operations in all or any portion of the Food Service Areas pursuant to the terms and conditions of this Agreement and the Food Service Plan, and such failure shall continue for more than seven (7) Days after notice to Manager from the Director, then an Event of Default will have occurred, and the Authority may invoke any of the remedies afforded under this Agreement, at law or in equity.
Concession Operations. Subject to the limitations stated herein, the Manager has the limited exclusive right to provide the Concession Operations at XxXxxxxxx Place in the manner set forth below. The Concession Operations require constant and timely attention to ensure product quality and customer service to the Clients and guests of the Authority. The Concession Operations include the following: selling food and beverage at restaurants, bars, cafes, fast food outlets, permanent concession areas, portable concession, and in any other spaces not listed below but which, during the Term of the Agreement, may be designated by the Authority as an additional location for Concession Operations. The Authority desires unique, branded (local, regional, and national), and diverse concession facilities to be operated throughout the XxXxxxxxx Place campus. These will include, but will not be limited to, mobile-thematic, semi- fixed kiosks or other apparatus, fixed kiosks, and fixed foodservice operations. In addition to self-operated concessions operations, the Manager will have the opportunity to operate franchised outlets and will be required to manage all Retail Food Licenses and integrate their operations into a seamless package of concession offerings to customers, contractors, and employees of XxXxxxxxx Place.
Concession Operations. Each party, or its operating agent, has the right to operate concessions in its own assigned areas, and the proceeds shall go to the party operating the concessions. Each party is responsible for ensuring that appropriate health and safety regulations are observed.
Concession Operations. Parks and Concessionaire agree that Concessionaire shall be permitted to operate specific concession operations, which are generally described as follows: A more specific description of, or additional information relating to, Concessionaire’s permitted concession operations may be attached hereto and incorporated by reference as an exhibit to this Agreement. Unless otherwise expressly provided in this Agreement, or in any exhibit, addendum, or amendment hereto, nothing herein shall provide Concessionaire with exclusive rights to perform concession operations anywhere else within the State Parks system or at other properties of the State of Arkansas. Accordingly, Xxxxx reserves the right to enter into other Concession Lease(s) Agreements which it, in its sole and absolute discretion, deems beneficial to the State Parks system and its visitors.
Concession Operations. Subject to the subsequent provisions hereof relating to Landlord's "festivals", Tenant shall maintain, during and in respect of all of the Landlord Events, the sole and exclusive right (but not the obligation) (i) to operate all concession facilities and operations at the Amphitheater including, without limitation, the sale of food, beverage, alcohol and merchandise at the Amphitheater and (ii) to receive and retain all revenues associated with the operation of such concession facilities and operations at the Amphitheater during the Landlord Events (which revenue shall constitute "Gross Revenues" for all purposes of this Lease). Tenant agrees to exercise reasonable efforts to convince its concessionaires to open for business and operate throughout all Landlord Events; provided, however, that Tenant shall not be liable or responsible to Landlord should any of such concessionaires elect not to open its concession business during or as a part of any of the Landlord Events. Upon request of Landlord, Tenant shall notify Landlord within ten (10) business days following receipt of such request as to which of Tenant's concessionaires intend to be open for business during Landlord Events designated in such request which are scheduled to occur within four (4) months following such request. If any of Tenant's concessionaires elect not to operate its ordinary concession facilities and operations at the Amphitheater during the presentation of any of the Landlord Events, then Landlord shall have the right and option to arrange for and provide for the sale of the type of concession ordinarily sold by each such concessionaire at the Amphitheater by or through concessionaires of its choice; provided, however, that Landlord shall have no right to use the existing concession facilities and improvements at the Amphitheater without the prior consent of Tenant's concessionaires. Notwithstanding the foregoing provisions, Tenant hereby agrees and acknowledges that, with respect to those Landlord Events which are "festivals," the service of food and beverages as a part of, and consistent with past practices at, any such festival shall be permitted and shall not violate the Tenant's exclusive right to operate food, beverage and merchandise concessions at the Amphitheater.
Concession Operations. LICENSOR agrees to allow and LICENSEE agrees to conduct concessions operations (“Concession Operations”) at the facility, at such locations and on such dates and times, selling such products as LICENSOR may designate from time to time, in accordance with LICENSOR instructions. The Concession Operations shall be conducted in a courteous, efficient and safe manner. Any concession stand operated by LICENSEE must be staffed by member of the LICENSEE only.
