Compliance with Xxxxxxxx. Regulations (29 CFR 3): The contractor shall comply with the Xxxxxxxx Regulations of the Secretary of Labor which are herein incorporated by reference.
Compliance with Xxxxxxxx. Xxxxx Act of 2002. The Company and, to the best of its knowledge, its officers and directors are in compliance with applicable provisions of the Xxxxxxxx-Xxxxx Act of 2002 and the rules and regulations promulgated in connection therewith (the "Xxxxxxxx-Xxxxx Act") that are effective and are actively taking steps to ensure that they will be in compliance with other applicable provisions of the Xxxxxxxx-Xxxxx Act upon the effectiveness of such provisions, including Section 402 related to loans and Sections 302 and 906 related to certifications.
Compliance with Xxxxxxxx. “Anti-Kick Back” Act: In carrying out this agreement, the contractor agrees to comply with the requirements of the Xxxxxxxx “Anti- Kick Back” Act (18 USC 874) as supplemented in US Department of Labor regulations 29 CFR Part 3, respective to all contracts and subgrants for construction or repair services.
Compliance with Xxxxxxxx. Act Require- ments;
Compliance with Xxxxxxxx. “ANTI-KICKBACK” ACT The CONTRACTOR shall comply with the Xxxxxxxx Anti-Kickback Act (18 USC 874 and 40 USC 276c) as supplemented by Department of Labor regulations (29 CFR Part 3, “Contractors and Subcontractors on Public Buildings or Public Works Financed in Whole or in Part by Loans or Grants of the United States”). The Act provides that Contractor or subcontractor shall be prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public facilities, to give up any part of the compensation to which they are otherwise entitled. SC-17 ENERGY EFFICIENCY The Contractor shall comply with the Energy Policy and Conservation Act (P.L. 94-163). Mandatory standards and policies relating to energy efficiency, contained in any applicable State Energy Conservation Plan, shall be utilized.

Xxxxx There is and has been no failure on the part of the Company or, to the Company’s knowledge, any of the Company’s directors or officers, in their capacities as such, to comply in all material respects with any provision of the Xxxxxxxx-Xxxxx Act of 2002 and the rules and regulations promulgated in connection therewith (the “Xxxxxxxx-Xxxxx Act”), including Section 402 related to loans and Sections 302 and 906 related to certifications.
Compliance with Xxxxxxxx. Xxxxx Act. Until the completion of the distribution of the Common Shares, the Company will comply in all material respects with all applicable securities and other laws, rules and regulations, including, without limitation, the Xxxxxxxx-Xxxxx Act, and use its best efforts to cause the Company’s directors and officers, in their capacities as such, to comply in all material respects with such laws, rules and regulations, including, without limitation, the provisions of the Xxxxxxxx-Xxxxx Act.
Compliance with Xxxxxxxx. “Anti-Kickback” Act. Subrecipient shall comply with 18 USC Section 874, 40 USC Section 3145, and the requirements of 29 CFR Part 3, as may be applicable, which are incorporated by reference into this Agreement.
