Compliance with Section 2. 3. NEN shall only order unbundled elements in accordance with Section 2.3 herein and it will be the responsibility of NEN to make arrangements for the delivery of interexchange traffic and routing of traffic over interoffice transmission facilities, if applicable.
Compliance with Section 2. 03. The Borrower shall have complied with Section 2.03 of this Agreement in all respects regarding such Revolving Credit Loan.
Compliance with Section 2. 3. NEWSOUTH shall only order unbundled elements in accordance with Section 2.3 herein and it will be the responsibility of NEWSOUTH to make arrangements for the delivery of interexchange traffic and routing of traffic over interoffice transmission facilities, if applicable.
Compliance with Section 2. 8(c). The terms of such Incremental Facility and the applicable Incremental Loans are in compliance with Section 2.8(c) of the Credit Agreement.
Compliance with Section 2. 02. No BKFC shares of stock or payment in lieu of fractional shares shall be delivered by BKFC to any former holder of FTFC common shares in accordance with this AGREEMENT until any such holder shall have complied with paragraphs (a) through (e) of Section 2.02 of this AGREEMENT.
Compliance with Section 2. 5. No shares of RDSI Common Stock or payment in lieu of fractional shares shall be delivered by RDSI to any New Core Holder of common shares in accordance with this Agreement until any such holder shall have complied with Section 2.5 of this Agreement.
Compliance with Section 2. 03(a) and (b). In the event AHR does not comply with Item 2.03(a) and (b), this Agreement shall be null and void and all transactions unwound to put the parties in their original position prior to entering this Agreement. Should enforcement of this item 8.02 become necessary, AHR will be responsible for any and all expenses incurred from the date of closing.
