Common use of Compliance with ADA Clause in Contracts

Compliance with ADA. The Hospital and the Association agree that the Hospital shall be permitted to take any and all actions necessary to comply with the Americans with Disabilities Act (ADA) to avoid liability under the provisions of said Act. If such actions necessitate violation of a provision of this Agreement, then the parties agree to bargain with regard to the effect of such action on other bargaining unit employees.

Compliance with ADA. The Hospital and the Association agree that the Hospital shall may be permitted required to take any and all actions necessary to comply with the Americans with Disabilities Act (ADA) to avoid liability under the provisions of said Act. If The Hospital may take any action that it is obligated to take under the ADA provided such actions necessitate violation do not violate any terms of a provision the parties’ labor agreement including but not limited to the seniority provisions of this Agreement, then the parties agree to bargain with regard to the effect of such action on other bargaining unit employees.

The Hospital Medical Center and the Association further agree that the Hospital Medical Center shall be permitted to take any and all actions necessary to comply with the Americans with With Disabilities Act (ADA) and to avoid liability under the provisions of said Act. If such actions necessitate violation of a provision of this Agreement, then the parties agree to bargain with regard to the effect of such action on other bargaining unit employees.
