Completing Transactions. We refuse to complete a transaction: • If you do not have enough money in your account; or • If you would go over your credit limit; or • If it would lower your balance to less than the required balance; or • It would require us to change the money that we hold for the account Electronically created items (ECI). Electronically created items including emailed payments are non-conforming images. However, we reserve the right to collect the funds when the item is returned. Other Minnesota Disclosures. Automatic Teller Machine (ATM) transactions are completed immediately with us. You cannot reverse a transfer of money through an ATM. Payment for goods or services by transfer of money through an ATM does not affect any of your rights, protections or liabilities under existing law concerning a cash or credit sale made by means other than through use of an ATM. We are liable for all unauthorized withdrawals at an ATM or Point of Sale (POS) transfers unless the unauthorized withdrawal was due to loss or theft of the card, in which case you are liable, up to a maximum liability of $50 for those unauthorized withdrawals made before we are notified of the loss or theft. The limitation on liability is effective only if the card issuer is notified of the unauthorized charges contained in a bill within sixty (60) days of receipt of the bill by the person in whose name the card is used. An unauthorized withdrawal is a withdrawal by a person other than you who does not have actual, implied or apparent authority for such withdrawals, and from which withdrawals you receive no benefit. You may bring a civil action against any person violating the consumer privacy and unauthorized withdrawal provisions of Minnesota law. In addition to actual damages or $500, (whichever is greater) you may recover punitive damages, plus court costs and reasonable attorney’s fees incurred. To protect the privacy of customers using electronic financial terminals, including any supporting equipment, structures or systems, information received by or processed through such terminals, supporting equipment, structures or systems shall be treated and used only in accordance with applicable law relating to the dissemination and disclosure of such information. The person establishing and maintaining an electronic financial terminal, including any supporting equipment, structures or systems, shall take steps as are reasonably necessary to restrict disclosure of information to that necessary to complete t...

Completing Transactions. All transactions must be completed online unless the Company has agreed otherwise in writing with Nets, or in the case of emergency procedures. The following must be observed for completing transactions using the terminal: • The total transaction amount must be entered on the terminal • If there is any doubt as to the authenticity of the card, the card can be examined, and/or Nets can be contacted • If the card is declined, the Payment may not be completed. Follow the instructions on the terminal display • Ask the Cardholder to present documentation of ID if there is any doubt as to whether the Cardholder is the owner of the Dankort being used • For signature transactions, ensure that the Cardholder’s signature on receipts matches the signature on the card • For signature transactions, the Company must check that the date and amount on the receipt are correct, that the digits of the card number shown on the receipt are identical to any card number embossed or printed on the card • if the terminal shows a code that means that the card must be retained, the Company must refuse to accept the card as a means of payment. If possible, confiscate the card. Confiscated cards must be handed over to a bank. Emergency procedure An emergency procedure is to be used in cases where the terminal cannot complete online transactions with Nets because Nets has issued notification of technical problems, or the terminal’s phone connection is not working. The Company can use the terminal’s offline or enter function to complete the transaction with a physical Dankort. It is not possible to apply the emergency procedures for transactions made by Dankort on Your Mobile. For further information, please refer to the terminal instructions. When, as part of the emergency procedure, the Company completes a signature transaction, the Company must proceed as follows: • Check that the card is valid, i.e. that the expiry date has not passed. If the card is not valid, the transaction must not be completed. • Call Nets on tel. +00 00 00 00 00 to find out whether the card is active. The Company will receive a verification code if the card is active • Enter the amount on the terminal in the usual way • Enter the verification code on the terminal • Ask the Cardholder to sign the Receipt • Check that the signature on the Receipt matches the signature on the card • Give the card and a copy of the Receipt to the Cardholder • Ask the Cardholder to present documentation of ID if there is any doubt ...

  • Recurring Transactions If you intend to use the Card for recurring transactions, you should monitor your Balance and ensure you have funds available in your Card Account to cover the transactions. “Recurring transactions” are transactions that are authorized in advance by you to be charged to your Card at substantially regular intervals. We are not responsible if a recurring transaction is declined because you have not maintained a sufficient Balance in your Card Account to cover the transaction. If these recurring transactions may vary in amount, the person or merchant you are going to pay should tell you, 10 days before each payment, when it will be made and how much it will be. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set with that person or merchant. If you have told us in advance to make regular payments (i.e., Recurring Transactions) from your Card Account, you can stop the payment by notifying us orally or in writing at least three (3) Business Days before the scheduled date of the transfer. If you call, we also may require you to put your request in writing and get it to us within 14 days after you call. If you order us to stop one of these payments three (3) Business Days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages. If you have authorized a merchant to make the recurring payment, you should also contact the applicable merchant in order to stop the transaction. Fraudulent Card Account Activity. We may block or cancel your Card Account if, as a result of our policies and procedures, we reasonably believe your Card Account is being used for fraudulent, suspicious, or criminal activity or any activity that is inconsistent with this Agreement. We will incur no liability because of the unavailability of the funds that may be associated with your Card Account.

  • Final Approval Order 62. The Parties shall jointly seek entry of a Final Approval Order, the text of which the Parties shall agree upon. The dismissal orders, motions or stipulation to implement this Section shall, among other things, seek or provide for a dismissal with prejudice and waiving any rights of appeal.

  • Non-Arm’s Length Transactions Except as disclosed in the Prospectus and to the Agent, the Corporation does not owe any amount to, nor has the Corporation made any present loans to, or borrowed any amount from or is otherwise indebted to, any officer, director, employee or securityholder of any of them or any person not dealing at “arm's length” (as such term is defined in the Income Tax Act (Canada)) with any of them except for usual employee reimbursements and compensation paid or other advances of funds in the ordinary and normal course of the business of the Corporation. Except as described in the Prospectus, no officer, director, employee or securityholder of the Corporation has any cause of action or other claim whatsoever against, or owes any amount to, the Corporation except for claims in the ordinary and normal course of the business of the Corporation such as for accrued vacation pay or other amounts or matters which would not be material to the Corporation.

  • Billing Increments Unless otherwise stated in a Service Order, usage-based charges will be billed on either a per-minute or per- message basis. Service calls invoiced on a per-minute basis will have an initial minimum call duration of one (1) minute, subsequent intervals of one (1) minute each, and will be billed by rounding to the next whole minute.

  • Split Transactions You can instruct a merchant to charge your Card for part of a purchase and pay any remaining amount with cash or another card.   • Final Approval Order and Judgment 68. Plaintiff’s Motion for Preliminary Approval of the Settlement will include a request to the Court for a scheduled date on which the Final Approval Hearing will occur. Plaintiff shall file her Motion for Final Approval of the Settlement, and application for attorneys’ fees, costs, and expenses and for Service Award for the Class Representative, no later than 45 days before the Final Approval Hearing. Transactions involving your savings and checking accounts will be subject to the terms of your Membership and Account Agreement. Transactions involving your loan accounts will be subject to your applicable Loan Agreement and Disclosures.
