Completing the Work. I will cause the Contractor to begin the Work promptly after the loan closing and all permits are in place. I will use my best efforts to ensure the Contractor continues the Work diligently according to the Schedule and in a commercially reasonable and workmanlike manner in strict accordance with the Construction Contract and all Government Regulations. The Work will not violate any of the conditions, covenants, or restrictions on the Property. I will notify Lender promptly in writing if: (i) I think that the Work does not comply with the Construction Contract or this Loan Agreement; (ii) any notice of lien on the Property is served on me or Contractor; or (iii) any Government Authority issues any notice or claim relating to the Property. I acknowledge that the Construction Contract represents that the Work will be completed on or before _________________ (“Completion Date”), subject to modifications in approved Change Orders. I agree that the Work must be completed no later than twelve (12) months after the loan closing (“Completion Deadline”), and no later than eighteen (18) months after the loan closing if Lender agrees in writing to extend the Completion Deadline. I may request that Lender extend the Completion Deadline only if (i) I am not in default under any of the Loan Documents or the Construction Contract, and (ii) the construction cannot be completed on time because extenuating circumstances exist that are beyond my control. Lender will accept the Work as completed when I satisfy all of the conditions in Section 2.8.4.5 of this Loan Agreement. I acknowledge and agree that if the Work is not completed by the Completion Deadline, it will constitute an Event of Default under Section 3.1 of this Loan Agreement. Inspections. Lender and those acting on Lender’s behalf have the right to enter the Property to inspect the Work, without notice to me, during normal business hours, or any other times that Lender arranges with me. I will pay for all inspections performed at the request of Lender or any Government Authority, at the prevailing rate. Lender inspections are for Lender’s benefit only. Lender’s inspections create no liability or responsibility to me, Contractor, any Suppliers, or any third parties. Lender is not obligated to inspect the Property or the Work. I acknowledge and agree that if Lender or its designee are unreasonably denied entry to the Property to inspect the Work, it will constitute an Event of Default under Section 3.1 of this Loan ...

Lender will accept the Work as completed when I satisfy all of the conditions in Section 2.8.4.6 of this Loan Agreement.

I PROMISE THE WORK WILL BE COMPLETED ON OR BEFORE SIX (6) MONTHS AFTER THE CLOSING OF THE LOAN (“COMPLETION DATE”); PROVIDED, IF THE WORK CANNOT BE COMPLETED BY THE COMPLETION DATE DUE TO A TORNADO, FLOOD, FIRE, OR OTHER ACT OF GOD, I MAY REQUEST AN EXTENSION OF THE COMPLETION DATE TO A DATE THAT WILL ALLOW THE WORK TO BE COMPLETED THAT IS AS CLOSE AS REASONABLY PRACTICABLE TO THE COMPLETION DATE, AND LENDER MAY GRANT SUCH EXTENSION, IN ITS SOLE DISCRETION, ON THE SAME TERMS AND CONDITIONS CONTAINED IN THIS LOAN AGREEMENT. LENDER WILL ACCEPT THE WORK AS COMPLETED WHEN ALL OF THE CONDITIONS IN SECTION 2.7.2 OF THIS LOAN AGREEMENT ARE SATISFIED.

Borrower will notify Lender immediately in writing if (i) Borrower thinks that the Work does not comply with the Construction Contract or this Loan Agreement; (ii) any notice of lien on the Property is served on Borrower or Contractor; or (iii) any Government Authority issues any notice or claim relating to the Property. Borrower promises the Work will be completed on or before ("Completion Date"). Lender will accept the Work as completed when Borrower satisfies all of the conditions found in Section II (G)(3)(f) of this Loan Agreement.
Completing the Work. Borrower will complete the Work in accordance with the following provisions: The Work will begin promptly after Borrower signs the Loan Documents. The Work will continue diligently and in a good and workmanlike manner in strict accordance with the Construction Contract (if any), the Supplier Contracts and all Government Regulations. The Work will not violate any of the conditions, covenants or restrictions on the Property. The Work will be completed free and clear of any mechanics liens. Borrower will notify Lender immediately in writing if (i) Borrower thinks that the Work does not comply with the Construction Contract (if any), the Supplier Contracts or this Loan Agreement; (ii) any notice of lien on the Property is served on Borrower or Contractor (if any); or (iii) any Government Authority issues any notice or claim relating to the Property. Borrower promises that the Work will be completed on or before July 1, 2015 (“Completion Date”). Lender will accept the Work as completed when Borrower satisfies all of the conditions in Section 2.8.4.7 of this Loan Agreement (Completion Of Improvements).

Related to Completing the Work

  • Continuing the Work The Contractor shall carry on the Work and adhere to the progress schedule during all disputes, disagreements or alternative resolution processes with the Owner. The Contractor shall not delay or postpone any Work because of the pending resolution of any disputes, disagreements or processes, except as the Owner and the Contractor may agree in writing.

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.

  • Conditions Affecting the Work The Contractor shall be responsible for having taken steps reasonably necessary to ascertain the nature and location of the Work, and the general and local conditions, which can affect the Work or the cost thereof for any Job Order. Any failure by the Contractor to do so will not relieve him from responsibility for successfully performing the Work without additional expense to the County. The County assumes no responsibility for any understanding or representations concerning conditions made by any of its officers or agents prior to the execution of this Contract, unless such understanding or representations by the County are expressly stated in the Contract.

  • Access to the Work The Design Professional and its representatives shall have access to the Work at all times while it is in progress, and shall comply with all job site safety rules.

  • STOP WORK (a) SELLER shall stop Work for up to ninety (90) days in accordance with any written notice received from LOCKHEED XXXXXX, or for such longer period of time as the parties may agree and shall take all reasonable steps to minimize the incurrence of costs allocable to the Work during the period of Work stoppage.

  • Site Work An expansion of the Connecting Transmission Owner’s Boonville Station is required to accommodate the CTOIFs. The southern corner of the fence line will be expanded out by approximately 3,200 square feet. The Connecting Transmission Owner already owns the property required for the expansion. Approximately 120 feet of the existing fencing will need to be removed and approximately 150 feet of new fencing added.

  • Project Work PURCHASER shall complete the following projects in accordance with the specifications provided in Exhibits B, C, D, E, and F and written instructions from STATE.
